After a suspense of :trt minutes, the rifle was lowered and the vnuld-le. killer voluntarily stir- J rendered1- to the officer. He was promptly taken to Jacksonville, after which the sheriff returned to arrest, the boy and girl. "Wo had plauned to raid the Short' iilaee with the assistance of several f (.rTleers. - "said the sheriff today, when giving nn account of the affair. "and in .order to have our plans carry successfully, the federal officer and I came to the scene Tuesday evening u watch the place, which1 we did until 2 o'clock the following morning. For a few hours we slept i in a barn until daylight when we resumed our vigil from an advan tageous point. We watched Shannon take the still, n large copper cylin-l dricnl tank from Its Ingenious hiding! placo in- a brush covered hole, to tt creek nearby. Noticing that a car' was being loaded with booze, we changed our position to the main I road in order to await Its arrival1 from the farm house. I "After nn hour they had not ar rived. Tired of waiting we walked to the house, a half mile away. Tpon ' our arrival Denny Short, a brol her of Bill, started to run. When I saidj 'Hold oh Denny, I want to see you.'j yning nnd yelling to Dill Short, 'Don't! Shoot.' I "At this time my attention was so1 centered about the fleeing man, that I did not notice the intent of Hill's' actions as he reached Into the car to do, what I thought, destroy the booze, but Instead leveled a high power Savage rifle at me. With his gun pointed at nte, he said.j 'Well, let's go. Raise that gun.'; which I had drawn when I attempt ed to stop Denny, but which then i was hanging at my side. "I sincerely believe he meant to shoot It out, but I did not raise the: gun, nnd consequently I om still among the living. His rifle was bmded, and the hammer on safety, ready to be pulled back. j 'Tor fifteen minutes we stood 1 there before anything further de-1 ve loped. Dede, another brother, du1'-I Ing this time had hidden close to the house, realizing the situation if he appeared In the open. Without saying a word he came from his hiding place, and climbed into the ; Ford touring car, which was loaded with the booze. Short then ordered.' 'Take this stuff and get rid of It.'j and without answering the youth Irove away. I While the boy was In the ear. ' Short changed his position so as to be between the car and us to watch the movements of both. He resumed bis former position by leveling the riflo across the fence. I remon strated with him to think of his ac tion, which I told him was far moro serious than the bootlegging charge, which would have been ordi narily preferred against htm, but I met with no favorable response. "Within a short distance, flow ing In the waters of Muddy creek, a tributary of Applegate river, I watched 80 gallons , of mash go by, having been tipped out of two bar rels hy Roland Read, one of Short's helpers. The mash was apparently new. It had not yet shown any no ticeable signs of fermentation. "MrCredie requested Short for n smoke, but received the answer, 'not J yet "Fearing he could not go through with It, he suddenly set down his! gun nnd came beside me nnd said. 'I 11 go in with you ns soon an tho boy gets back. but the boy never returned. Short then came with nie search for the missing car, which found later n half mile distant the brush, with all the liquor gone except one hair gallon which the boy must have overlooked in his excite-! ment to cache the other eight and n half gallons. whl h Short said were In the car, and which ns yet have not been found. "We returned to the farmhouse In the Ffrd nnd proceeded to Jack sonville where Short was put in Jail. When we returned District Attorney fhatny necompanled to question other members of the party. During our absence Roland Rend had com pletely demolished the still with the use of an axe to destroy the0 evi dence. The girl, its well as the boy. were then taken Into custody, the latter having hetcd to Joad the ; booze.
