The surprising feature of the controversy is that the lenders in

opponents were in reality the defenders of those princiides of per
sonal liberty upon which this government was founded.
As The Mail Tribune pointed out at the time, there was and is a
decided difference between favoring the public school Nystem and
favoring the exclusion of every other system of education. The
question became not one of education, but one of individual rights,
whether the question of a child's education should be a matter of
Mate authority or parental authority.
The Supreme Court and the lower court decided that the parents
comes first.'thaMhc state comes second; the parent has the supreme
right to decide what type of education the child shall have; the
state can not dictate the type, but
them conform to a proper standard of education and Americanism.
This decision is strictly in accord with the letter and the spirit
tf the American constitution. The trouble with the proponents of
the measure licing that they were not familiar with the letter of
the document, and in their misunderstood zeal, had become alienated
from its spirit of liberty and tolerance.
