(Special) Important among the laws enacted at the last session -of -the . legislature having to do with the' administration of the workmen's compensation act -ya one introduced by Representa tive Fuller of Polk county which provideB that the benefits of ' this law shall be extended, to . all sala ried peace officers of the state, coun ty 1 and municipal corporations' This amendment becomes effective on May 28. ' " ';L''' " Cities and towns desiring to re ject the act 'should -notify thelnduB trial accident commission by May 28, otherwise they will not have nn op portunity to file their rejection until a year from that dateV ' -A similar ruling applies to- county court with Relation to Bhcriffs and their depu-tles.- Thls amendment includes a spec ial provision that municipal corpo rations that have provided by ordi nance or charter compensation' 'for peace officers injured in the course of their employment, such officers shall not be ehtltled' to the benefits of the net. . This provision appar ently was intended to exclude police officers in the city of Portland. Senate Bill No. U4 introduced by Senator Magladry Include a number of amendments to the present Work men's compensation act, intended to clear up the status of workman. In years past the commission has had considerable trouble in deter- mining whether certain workmen) were enTployees, piece workers or independent contractors.. Especially was this true in cases of men cm ployed In station work. Under the new amendment this difficulty is eliminated through a provision Hint "whenever workmen associate them selves together under a partnership ' agreement or as Individuals enter Into a contract, the principal pur pose of which is the' .performance of labor on a particular piece of work, such work to bo performed by themselves or with the assistance of other workmen employed by them, all such workmen shall be deemed employees of the persons having such work done, and not independent contractors." , Another Important amendment provides a penalty for failure to no tify the commission that a person Is to engage in,1 a - hazardous occupa tion, . The exuding law provides that no -person, firm or corporation shall cn- gaga as an employer in any hazard ous occupation unless and until such person, firm or corporation shall have filed with the Industrial Accident- commission a statement that Bald person, "firm or corporation in tends to engnge in such an occupa tion ana describes the same. The' amendment provides that "if any person, firnt or Corporation shall engage in any hazardous occupation as defined by this act, and does not file such notice with the commission, and any workman working for said person, firm or corporation shall re icelve an accidental Injury in the course of his employment, such in jured employe, or, if death results from the injury, his widow, children or other dependents shall, elect whether to take under the act or secure a remedy direct against such person, firm or corporation. "If the injured employe elects to come under the act, he shall assign to the state Industrial Accident com mission his cause of action, and the commission may recover from his employer the amounts the commis sion has expended, for compensation, 'WVS aid. etc." ' Th. rhe experience ratlnir nton h. been changed by ' amendment. ' Under1 the present law an employer working under the workmen's com pensation act starts at a base rate. If his experience rating is good his rating can be reduced 30 per cent. On the other hand, If hlg experience rating is bad his rating may be ad vanced to 16 per cent above base. Under tho new law no person shall receive more' than 10 per cent for good experience, and the 15 per cent penalty for bad experience is elimi nated.: This change In the law will i undoubtedly be a great benefit, as the is per cent penalty for bad ex perience, or bad luck, has caused much-dissatisfaction In the past.
