Coy Bur nett, Edwin E. Hookbcrt and Russell E. Sewell, Portland attorneys, will re ceive only $21,000 in attorney fees, instead of 1 150,000, for their work as counsel for V. Tyler Smith, next of kin of the late Mrs. Xnrlfa J. Failing, In a suit contenting her will. This is the decree of the stato supremo court In an opinion handed down todny and written by Justice Drown. The law yers demanded a third of the estate. Mrs: Fulling died July 6. 1917, leaving an estate of about $500,000. On July 9, says the rec6rd, Thomas W. Strong and O. L. Mead, offered for probate a purported will, dated Aug ust 26, 1915, naming several legatees who were to reeelvo $3000 each, all of the rest of the estate, amounting to about $450,000 to go to Strong nnd Mead, in equal shares. They were nominated in the will as executors and were so appointed. On grounds that Mrs. Falling was not of sound mind when this will was made, W. Tyler Smith, as next of kin, brought suit to have the will declared Invalid, and Burnett. Heckbert and Sewell were his attorneys. In the course of the trial evidence ucvolopod that In 1911 Xarlfa Failing had made a will to which she later added six codicils, and that in this will, the disposition of her property was wholly different from that of the probated will. Petitioners allege that upon learning of the 1911 will assign ments certain bequests made by that will were executed and delivered to W. Tyler Smith, nnd that on July 2. 1918, an amended petition on behalf of Smith was filed In the contest, also on behalf of all other beneficiaries under the 1911 will. When this went to court it is said 82 days were con sumed in hearing testimony, and the probate court sustained the will of 1915. An appeal was taken to the circuit court where the trial occupied fifteen days, and the circuit court upheld the probate court. Appeal was taken to the supreme court which reserved the lower court. One of the main beneficiaries was the Children's homo in Portland, and Justice Brown's opinion stntes that if fees are paid from the funds of the estate the children's homo would be the principal payer. . "We have no power," says the opin ion "to recognize a contingent con tract that was never made by the children's home. Moreover a claim such as the claim of petitioners for a contingent fee of one-third of this estate, consecrated to , a charitable purpose, has no merit In a court of equity." W.
