HOMER PELLETT ACQUITTED ON E Homer Pellett, charged with driving an automobile while Intoxicated was acquitted by a jury In the circuit court Friday afternoon, after short delibera tion. The case was carried to the higher court on an appeal from the justice court, where Pellett after two trials, was convicted. Pellett was called to the wltncps stand- in his own bohalf, and denjed the allegations of the-rftate,.tliat, he was Intoxicated1. Wltneses for the state testified, that following the ac cident, In which Busscll Wells sus tained a broken leg, they smelled liquor on his breath, that his face was flushed and that ho was excited. The accident occurred about 4:30 o'clock on the afternoon of July 26th, this year. The defense called John S. Orth and T. E. Daniels, who testified that thoy had talked to Pellett; a short time after the accident, and that they could smell no alcoholic odors. Attornoy George Roberts defended Pellett. Bids wero advertised for the building and when it came time to let the contract it appeared that this sum was Insufficient in tho Judgment of the board. Accordingly after con-' ferrlHR with a few of the citlzona of the district, they felt Justified in let ting the contract for seven thousand two hundred and seventy two dollars, or near this sum. Then the ques tion arose as to where the rest of the money would come from, and It was decided to hold another meeting to get additional funds, or so it wns stated on the posters. ' Finding . bo much opposition, however, . thoy fl nnlly asked the voters to endorse the budget as it stood, and left the mat ter of financing the gymnasium until a later date. Much of the opposition was duo to misleading rumors which had gotten out. Phoenix will have one of the finest and most up-to-dato gymnasiums in the county when It Is finished. The building Is about 100 feet in length and will have a basement. It is built In such a manner that It will be Idem for basketball work, as well as other athletic sports. The ' high school pupils contemplate to give entertain ments and equip it In the moct up-to-dato' manner of any gymnasium In the country.
