The nmount involved is $500, alleged to bo due upon a note. , Hewitt, It Is nllegcd purchased an automobile from E. J. Jones, an auto snlosman. for $7.00, giving a $500 note for the balance. The bargain was for a Buick. car, but Hewitt was given a Maxwell car, pending the dollvery of the Buick. Jones, it Is alleged, sold the Citizen's Bank tho $500 nolo, and departed with tho Buick. In the mean time, a chattel lien against tlio Max well was served, and tho enr taken, leaving Hewitt, antoless. On these grounds, Hewitt refused payment of the note ami the bank starttnl suit.
