MINKOLA. March 10. With a
smile on her face, .Mrs. Mary Eliza
beth Wells walked out of the court
room early today, a free woman. Just
before midnight she was acquitted of
the murder of Captain James M. Pot-
tit, with whom she ltvod at Massa
pequa Inn. which he kept. . .
The Jury was out about five hours.
Mrs. Wells' acquittal followed
closely two convictions of women
charged with hnvlng slain men with
whom they had been Intimate. In
each case the trial Jury was chosen
because of a professed ability to Judge
testimony against women charged
with murder with their heads rather
than their hearts.
Her two predecessors, Mrs. Lillian
Raizen nnd Mrs. Pauletto Raludes,
unlike Mrs. Wells, admitted having
shot their victims to death. but
pleaded Justification and mental in
stability. At all times Mrs. Wells
maintained that she did not shoot
Captain 1'ettlt.
The basis of her defense was that
nho had no reason to punish rtuui.
Her lovo for him was too great, she
pleaded.
Miss Helen MeCormlek, ono of Mrs.
Wells' attorneys, told the Jury the
state had not established a motive
against her client. Tho beatings Cnp
tain Pettlt hart given her had been
cited, it was shown that ho had
taken all her savings, $7,000 and
squandered them, and frequently in
delirium threatened to kill her.

L. W. Peare, on trial at Coqulllo on
a charge of first degree murder, on
the witness stand today told ot kill
ing hlB neighbor, James Culver. Ho
claimed that his mind was blank con
cerning tho death of his wife.
He declared ho had been drinking
moonshlno and told of finding 1i!b
wife dead. Ho then decided to kill
his dogs and cats and to kill Cul
ver, ho testified, because, he felt tho
latter had caused him trouble.
Ho said he realized that ho had no
right to kill Culver but at the time
he had an overwhelming feeling to
commit the murder. He gave details
ot going to Culver's houBe and Bhoot
ing him twice. Peare claims that be
cause he was drunk, he was not clear
on many points. He rave his testi
mony in a quiet manner without any
show ot nervousness.

The prosecution In the enso of I., W.
Peare on tho charge of slnying James
Culver, his neighbor, today intro
duced in his trial at Coqullle testi
mony of officers and others who told
of tho killing by Peare of his wife
and Culver. After Peare had choked
his wife to death ho killed his cats
and dogs nnd then killed Culver, said
witness.
The defense made no effort to dis
credit the stories of tho witnesses,
indicating It would rely upon a plea
that Peare was Insane when tho mur
ders were committed. Peare was In
dicted on a chargo of second degree
murder In connection with his wife's
death nnd first degree murder In Cul
ver's ease. He is being tried on tho
latter charge now.
Tire prices must advance manufac
turers announced this week at Akron,
O. Tho increasing cost of crude rub
ber and fabrlo will make tire prices
from 7 to 15 per cent higher before
April 1, they predicted. Production in
the tire industry, 'however, 1b mount
ing Bteadily. The total production of
Akron rubber companies Is exceeding
100,000 tires daily and enlargement of
present quarters Is under way In many
of tho factories.
