ANGELICA. N. Y., March 15.
Seven women and two men perished
when tbe Alleghany connty alms
house on the outskirts of this village
was burned early today. Tbe fire
started from a gas explosion In tbe
basement of the two story wooden
stroclure where 2 4 women patients
were quartered and quickly spread to
tbe administration building.
Charles Sanborn, head stableman,
lost his life in an effort to rescue the
women Inmates. The night fireman
was killed by the explosion.
Six women were cremated In tbelr
beds and another killed when she
leaped from the upier window of the
blazing structure.
Sanborn made bis way Into tbe
blazing structure tbree times and
each time carried out one of the
women. On bis fourth trip Into the
building, the floor caved In and he
was burned to death.
Several of the rescued women
were badly burned, but all are ex
peeled to recover.
Tho loss to the burned buildings Is
estimated at $100,000.

two well known citizens, with Bert
L. Moses, county Janitor, were ac
cused from Ihe witness stand Wed
nesday, by Hank Johnson with being
members of tho gang that "took him
out.' The chargo was emphatically
denied.
Hoy Smith of Jacksonville was
called as a witness lo testify anent a
conversation he had with Johnson
"shortly after tho episodo," in which
chicken Btoalinq was tho subject.
"Johnson told mo," said Smith,
"thai ho had been accused of stealing
chickens, as asked mo what he
houlrt do. I told hltn If hn had
stolen tbe chickens there was nothing
ho could do. and ho said: "I stole the
chickens all right, but I dlun t get
as many as they said I did "
Axel Lundgreu was colled as a
character witness for Norrls and
Gooillo and left the witness stand re
luctantly with tho remark: "I haven't
told all I want to."

a member of his 'taking out party

County Judge Gardner, also named
by Johnson as a member of the party
characterized the testimony as "pre
posterous, and a lie without founda
tion of fact.''
The county Judge said he contem
plated filing a perjury charge against
Johnson. lleVt L. Moses also named
by Johnson, classified his charge in
emphatic fashion, as "a lie."

The motion of the defense for the
dismissal of the case, and a directed
verdict by the court, was overruled
by the court, without presentation of
argument by the state.
Attorney Winslow argiied that there
was an insufficiency of evidence, that
the indictments were Invalidated,
owing to the fact that the grand Jury
had listed John Doe's as members of
the party, when they had testimony
before them to connect other persons
with the crime, to-wit. County Judge
Gardner. Judge F. 1 Tou Velle and
Ilert L- Mosas, county Janitor, and
there had been no evidence lo show
that the defendants Norris and
Goodie were implicated, or had U3ed
any weapons during the affair.
Tom Goodie Testifies.
Thomas E. Goodie, defendant with
his father-in-law. J. Alexander Nor
ris. charged with riot in tho second
of the Jackson county nightriding
trials, was the first witness called by
the defense, at the Wednesday after
noon session of the circuit court, and
he told his story of the "hold-up" of
the night of April th. 1922. in which
Hank Johnson was "uplifted."
Goodie's story did not vary in es
sential points from that of Johnson,
the victim, and York, the "lectured."

on the main etreet of Jacksonville

of tho road, and turned, and then thoj

Goodie said "! was punched In the
ribs frequent with the pistols, and the
gang acted like a bunch of craiy men.
all yelling 'put 'em up.' He testi
fied the- wore robes and masks, lie
thought they were black, and all had
their handii covered with gloves. The
strength ef the band was placed by
Goodie at right or nine.
Goodie testified York w.m lid to
one ride and Johnson taken to a ree
and he and Norris were ordered to
drive down the road "and watt tiil
they were told to depart. He said
he looked around during the held up.

saw a car by the roadside, nnd that

Goodie replied: "There's a hold
up. They're looking for whiskey."

Johnson told him. "they put a rope
around my neck, and It felt pretty
comfortable."
Gvodie then testified the four men
returned to Jacksonville and John
son reported the matter to thv sheriif
but did not do so himself.
Goodie testified he did not want
the York boy to go on the trip, af
"my mother-in-law had hopped all
over me. for keeping him out late,
and I didn't need him." He said
York told him. when he remonstrat
ed, that he was going, and "not to
mind the old man."
Vic-Unas of Hold Vp.
The state, in cross-examination,
asked Goodie: "Are you a natural
ized citizen of the Invisible Empire
of the Ku Klux K'.an?" The defense
objected to the query, and it was sus
tained. Goodie denied that there
was any pre-arrangetrent for the
hold-up. and that be and Norris were
victims, and not principals as
charged. He said he had not been
asked about chicken stealing, but
had been Queried about moonshine,
and had been searched for a gun. by
the band.
Goodie's testimony varied from
that of Mr. and Mrs. Luther S. York,
parents of I'aul, who testified that
Goodie had called at their home, and
said he refused responsibility for any
thing that happened to I'auL
The third and last of the night
riding cases is next on the docket and
it is that in which Howard A. Hill,
orchardist and defendant in the Hale
Case and Bert L- Moses, named yes
terday by Johnson as a member of
his "taking out," are charged with
riot in connection with the alleged
kidnaping and hanging of George
Arthur Burr, colored bootblack, who
was given 'treatment" a week before
the Hale episode, at a lonelc spot in
