Elmer Simmons, Indicted by the
lust Brand jury on a charge of vio
lating the prohibition law. was ar
raigned in the circuit court Friday
and entered a plea of not suiUy, and
his trial m set for next October.
Himmons was detained by the Sis
kiyou county, California, officials,
and released upon 11000 bonds upon
arrival hero Thursday night. The
trial wns postponed upon the rlea
that he "had a IT a day job In the
woods near Weed," and that a con
tinuance would enable him to keep
his family and prepare his defense.
This was agreed to by the sheriff
and the district attorney. . .
As a side Issue of the arrest of
Hlnimons, Bert Moses, county Jailer,
quit his berth, and u man by the
name of Collins from Gold Hill was
appointed to fill his place.
Beveral years ago Simmons Is said
to have been a special deputy sher
iff investigating the supposed mur
der of a prospector, whose body was
found In the Applegate section.
Simmons disappeared about the
time of his indictment, and It was
rnmored that this was to be used s
the basis of a recall of Sheriff Tit
rill. That official immediately secured
a number of affidavits and the
source of the "tip" was revealed, it
is'clalmed. Simmons, in the pres
ence of a number of Jackson and
Siskiyou county officials. Including
Assessor Coleman, declared Sheriff
Terrill blameless, and vigorously re
fused to sign any affidavits against
him when requested.
