I The general impression around the court house was-there would be a dis j agreement. I Court Ciives Instructions The instructions of the court were : given to tile jury this morning upon the reconvening of court in the trial of. James (Shine) Edwards, charged jwith selling of intoxicating liquor, j The court explained to the Jury that the reason he had excused them yes terday afternoon at the conclusion of the arguments on both sides, was to give them a day for the deliberation of the case, as he did not consider it proper to keep a jury up all night for their deliberations. The court instructed the jury to bo guided solely by the evidence as given by the witnesses from the stand, and the law as given to them by the court, and to ignore In their deliberations the comments and legal opinions of counsel. The instructions set forth that the only issue in the case, was the sale of liquor by the' defendant, as charg ed in the indictment on the eighth day, of AugiiBt and that they must find the defendant guilty beyond reasonable) dougt. The court then gave the Jury, the legal definition of "reasonable doubt."' The court cautioned the jury that they should not in any. way destroy the evidence, but that, they might, in vestigate the contents of the, bottles by breaking the seals, if they so de sired. Violation of this rule, the court informed, would be contempt, of court, and would work a hardship on the state in the event of a retrial. The jury Was then escorted to the Jury room, and began Its delibera tions at 9:30 o'clock. Asks. Jury Probo . The closing arguments in the trial of James (Shine) Edwards were made Thursday afternoon by Attorney Gus Newbury for the defense, and by Dis trict Attorney Rawles Moore for the state. Considerable bitterness crop ped. out in the debates, the defense at torney castigating in vitriolic lan guaguage, the chief witness for the state, A. 13. Gates. The methods of the state in employing hiredi detec tives to procure evidence was. as sailed, and the charge made that the state of Oregon "prostituted itself by "using such tactics." Attorney Newbury said he "de manded, and. insisted upon a: grand Jury investigation of the expenditure of county money, whether it was. au thorized by the county sheriff, the Prosecutor, or the county court, in bringing in outsiders to. indttce men to commit crime".. ! "In my 20 years of experience be fore, this court, I have seen hundreds of liars take the witness stund, but in all my experience, I never saw or heard, so lle, so. licentious, so laciv ious a witness as this fellow Gates. 'If. L wanted to accurately describe him I would, have to take you outdoors, where no woman could hear, and then there-are not enough words in all-the dictionaries in the world to do the subject justice." District Attorney Moore In his clos ing address said there was but one issue involved, did the defendant sell liquor as charged, on the-eighth, day of August, to the state's witness. He. vigorously resented the imputation of the defense that he had "been un fair." ... ::i!iiiiiililiiillliiiliillililllllllllliliil Special at the Colonial Jersey Coats $5.50 Saturday Only j GO TO CHURCH SIX DAY, OCTOKER 30. liiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiiM 0IITUARV COY Clark Westerly Coy, son- of Mr. and Mrs. Samuel Coy of Eagle Point,.
