I I: .if Motion for the continuance of the trial of Ernest "Dud" Wolgainott, charged with being drunk apd disor derly, until Mouday, May 2, wos granted by Justice of the l'eacc (ilenn O. Taylor. The motion was filed by the district attorney's office, and was upon the grounds of "official busi ness," the plea setting forth that Assistant Ijlstrict Attorney George A. Codding, who was conversant with the facts in the case hud been called out of town. Attorney George M. Roberts, rep resenting Wolgumott, contested thu grunting of the contlnonnce upon the grounds that the defense had retain ed witnesses from California, and the country districts, at considerable ex pest), and that an immediate trial should be granted. Attorney Roberts ridiculed the ch.il m that "the dis trict attorney's office had official husinoss out of town." The court then granted tho motion, and objec tions were filed by the defense. The case created considerable lo cal Interest, arising out of the arrest at Orth Hall In Jacksonville lust Fri day night or Wolgumott , who was charged with being 'drunk' and dis orderly, "and has many untiles. " ..Attorney George Roberts was liiuf h Incensed over thu postpone ment .o thn ease and Issued tlm fol lowing statement this noon: "I have, never believed In making any Btutiiment lo a "newspaper prior to the trial of uny case, believing that tho case should be tried upon the evidence submitted (luring the trial and that no attempt of uny kind should he made to prejudice pros pective Jurors by statements made by either principals or attorneys prior to trial. However, having noticed Home alleged quotations of Deputy Sheriff McMahon relative to the Tacts underlying the Wolgumott case, I will say that this case was set for trial at 10 o'clock Wednesday In order of the court, based on agree ment of counsel, and that defendant was present with moic than nine witnesses, all of whom were ready and would have refuted these alleg ed statements of .McMuhou In every detail and while Mr. Monro, district attorney, was In his office, nnd over tho telephone asked for a continuance on the ground that the deputy dis trict attorney hud official business in Ashland, nnd he, Moore knew noth ing about the case, they were unable to go to trial, to which we strenu ously objected as we wanted this matter determined by a jury lit once in order to save time and expense for all parties concerned, yet this contin uance was granted."
