The one argument npaiust labor control by law has lonjr since lost validity. This argument was based upon the helplessness- of labor. It was maintained at the very dawn of labor organization, that such an association, not formed for pecuniary profit, should not be in corporated, should not be subject to legal restrictions, because such restrictions, would place it at an unfair disadvantage, iu the fight with capital, with its millions, its political power, its unserupoulous ness. That contention undoubtedly had some validity, when organized labor was an infant, when the wage earners were just emerging from a condition of economic serfdom. But it has no validity now. Or ganized labor today is not only full grown, it is in reality a giant. It is capable of great evil as well as great good. It can if it wills, dis organize a nation overnight, it has the power if it wills, to ruin, to starve. Nor can it plead poverty. Organized labor in this country, has millions to command. Therefore, there is no reason why today, organized labor should be any less subject to control by law and the courts than organized capital. In fact, the eXperienes of this country in recent years, the ex perience of Great Britain now, have raised public feeling to a point where legal restrictions are imperative. And the law is the only path of either u safe or desirable solution. The welfare of society is the rock of this covenant, and only by mak ing nil forces of society, capital, labor or what not, subject to the same laws, to the same treatment to the samo obligations, can a heal thy society endure. With Judge Gary's hatred of unionism, his .judgment that union ism in itself is a crime, his general economic philosophy as expressed ill yesterday's address, we do not agree at all. It is in our judgment bigoted, short sighted, woefully out of date. But on the o-eneral ground, of enacting just labor laws aiid compelling organizvd jabor to obey them, we believe he is entirelv right.
