A Jury in the circuit court this morning was hearing the civil suit of the Howard A. Kelley Hospital vs. S. S. mails for $200 aliened to be due for rndlum treatment applied In 191 ti lt. A. Matthews, defendant in the 15000 damage suit of Attorney W. E. Pliipps for alleged Injuries received in an unto accident on Riverside uvenue last October, and Attorney W. E. Crews for the plaintiff engaged in a verbal tilt with high pitched voices to the point where the court admonished both to use moderation. The point at Issue was whether Mr. Matthews had been negligent in notifying the author ities. Mr. Matthews was the first wit ness for tlie defense. i.iis. Sarah Saylor, an aged woman who waa riding In the back seat df the ear when the. accident occurred said when Attorney. Phipps was hit it "sounded like a baby buggy had been hit." She also stated that Mr. Mat thews, the driver of the car was blind ed by the lights of an approaching car, and that Mr. Phipps cried: "Why did you do it?" Mrs. Matthews, the. third wltnoss for the defense was also an occupant of the rear seat and testified, much of which was highly contradictory of the plaintiffs claims. She said that they offered to take "Mr. Phipps trf the doc tor's," btit he refused. She testified sho recognized Mr. Phipps "by his fig ure and walk and told of offorts to locate hlm; by phone the next day. On' cross examination by Attomey Crcws Mrs. Matthews said that after e crash she asked Mr. PhippB, ".What in' the world are you doing' iu the street?" . . . Queried as to how fur the Matthews car was from the curb, she maintained emphatically "it was eight feet be cause I know it. was eight-feot.": Homer Saylor, who picked apples for Mr. i.Iatthows, testified that 'ho 'was riding In the front seat of the car and corroborated the testimony 'Of his mother and Mrs. Matthews, it was raining hard at the time, and that his ..rst 'intimation of ; an nccldent was when -he saw '.'something black dead ahead." Like the other three defense witnesses he refute'd Mr. Phipps'-claim that he was dragged by the auto. Attorney Crews in the final argu ment for the plaintiff . told the jury that the real damage was $350, as proven by the testimony, but "It was for the jury to search their hearts" to find a just award for the mental anguish the plaintiff has undergone. On the other hand the city contended that the authority is given it to make such purchase under" the charter amendment known us the Hansen plan, and subsequent legislation by the leg islature. Mr. hehl contended that upon the sale of the lots at tax foreclosure sale,, the assessments, were extinguish ed and that the city had no liens upon the property aner the county pur chased It.
