Opening arguments by state and de
fense were made, and a jury finally se
lected la the case of Lark N. Evans, on
trial before Judge D. V. Kuyendall of
Klamath county, in tho circuit coift-t
this morning.
The jury selected after an entire day
of questioning and cross questioning,
in which every ehallengo allowed by
law was used, is as follows:

Outside of two merchants and a mu
sician, tho jury Is composed entirely of
farmers, and some of itB members are

In his opening statements to the
jury, District. Attorney Kawles Moore
told tho jury tho well known story of
the alleged crime, how W. (5. Whllo, a

fendant, Lark lOviins, and In company
with n woman purporting to ho his
wife, for a drive which culminated In

Falls. The defense filed an objection
lo this statement to the Jury.
Attorney (ins Newbury for tho do

and tho records of Medford firms that
at the lime when White alleges Kvans
was holding him up he was engaged in
putting a vacuum tank oil the Itluo
Ledge mine nuto, and will account for
his movements on the day of the al

new evidence upon which tho supreme
court granted a new trial, and W. H.
Coleman, Sam Sundry, Wilbur Antipole,
Charles P. Talent and .Mrs. What have
been subpoenaed. Sales and time rec
ords of the llincs Snider and A. W.
Walker garages and sales departments
will he Introduced in support of tlie
contentious.
Tlie defense will endeavor, according
to its chief counsel, lo show that al

the commission of the alleged crime,

Hefore the first testimony. Prosecu
tor .Moore rciuested that all witnesses
for the defense be excluded. Attorney
Newbury countered with tho request
that all witnesses for the state be ex
cluded. The court ruled that all wit
nesses for both sides he excluded from
the court, with the exception of the
prosecuting witness and the parents
of Hie defendant.
The first witness called by the state
was V. U. White, victim of the holdup
und kidnapping, a resident of Grants
l'ass, and a man past middle age. Al
most Willi his first words ho identified
Kvans as his assailant. He told of his
journey by auto from Grants Pass to
Jacksonville, and of being tied hand
and foot in an abandoned prospect
hole.

As the contracts between the mer
chants and the Trade Expansion com
mittee of the Medford Chamber of
Commerce expired on last Wednesday
and because there has been some delay
in merchants getting together on a re
vised campaign for trade expansion, no
weekly bargains are being collectively
offered this week.
Some of the merchants will continue
giving Wednesday bargains whether
or not it becomes an organized cam
paign as they have found that by so
doing they have made Wednesdays
their second best business day of the
week, whereas in the past that day has
been the poorest.
A meeting of all the merchants will
be called very soon for tho discussion
of trade expansion methods.

The new proprietors of the Eldridge
dairy, Messrs. J. W. Snider, D. O. Fred
erick and Howard Grover, took charge
today and are moving their milk and
cream station from North Grape to the
North Hartletl location where all their
business will be combined. They do
a wholesale butter, ice cream and pro
duce business and w holesale and retail
milk and cream business.
Mr. Kldridge has not decided what
he will do as he likes Medford very
much and may decide to re-enter some
kind of business here. Neville Eldridge
has accepted a position with the new
company and will remain here.
