The draft evasion charges, against William Harrison I Jack Dempsey, . heavy weight champion boxer of the world, and Jack Kearns, his manager were filed here In tho United States dis trict court. The statute covering them carries a maximum sentence oi! three years and a $2000 fine in Dempsey's case in the event of a con viction. There are two charges rest ing against him, ono actual dratt eva slon and the other conspiracy to ef fect such evasion. The Kearns case is covered only by the latter charge On the direct evasion charge Dempsey can lie given one and on the conspiracy charge two years and a $2000 fine. The indictments were returned February 27 following . statements made to the federal grand jury by Maxino Wayne Dempsey,,. divorced wife of the pugilist, that he cought her sworn testimony as to her depen dence on him in order, to. avoid mili tary service, and had given such testi mony against her will. Subsequently she retracted her charges in a signed affidavit submitted 'to the United States district uttornoy's office here, but despite such retraction the grand jury returned tho indictments.
