Lark Kvans had been married at Ta

her under an assumed name, and
that they separated and were only re

Prosecutor Roberts was caught
unawares as he had thought that
Mrs. Kvans would not take the stand.
He claims to have ample evidence
that Mr. and Mrs. Kvans were not
man and wife at the time of the rob
bery of White. Nothing had been in
troduced at the hearing by the state's
witnesses as to Mrs. Kvans having
taken part in the robbery except as a
witness.
Attorney Noff made a molion that
the case lie dismissed, citing the
statute that when a woman is charg
ed with a fi'lony or murder In com
pany with her husband the presump
tion is that the wife is under the co
