Rumely, Vice-president and treas urer of the Mail and Express com pany, publisher of tho New York Evening Mall, was arrested here last night In the office of Attorney Gen eral Lewis, charged with perjury in a report to A. Mitchell Palmer, alien property custodian. . The complaint against -Dr. Rumely charges that in making a report to nllnn:...n.n.t- ......l.ll.... ing the transaction, he failed to dis close his relation with Count Von IBernstorff, German ambassador to the United Statos, and Dr. Hclnrlch Albert, tin nttnplie nf tlin, flornlnn nm. bassy. Investigating Soino Time. The warrant was Issued by a fed eral commissioner upon tho complaint of Attorney General Lewis, who had liecn conducting an Investigation for some timo into the affairs of the Stall. The attorney general charged that Rumely purchased tho stock of the Slail and Express company In June, 1915, from Henry L. Stoddard and In doing so he acted on behalf of the imperial German government The attorney general charged that the Gorman government paid to Rumely In scvoral transactions con nected with the purchase of the Mail $1,361,000. Tho payments. It was alleged, were concealed until their details were discovered by investi gators for the department of justice and tho New York state attorney genoral. In an announcement today of the arrest of Dr. Rumely, Attorney Gen ' eral Lewis declared that tho money was paid to Rumely from deposits of the German government standing in the namo of Dr. Albert, or of Al bert and Von Bemstorff Jointly, in this city. Tho total so far traced he added, is $1,361,000. The transfers of money, Lewis said, wero concealed in manner. . S. McCliuo Is Involved. This firm, In turn, paid tho money over to Rumely or to the S. S. MeClure News paper corporation, which had beeu organized by Rumely for tho pur- poso of tho transaction. Mc Cluro Nowspnper corporation to se cure the loans. liumely Hides Facts. , "Dr. Rumely, In his report to the alien nronertv custodian, made no disclosure of his relations with Albert or Von Bemstorff. or tho Imperial German government. Instead, ho re ported that he owed $100,000 to Her man Slelcken. now deceased, upon n note, and he also reported that the potcs which )0 hud given Renskorf. Lyon & Company, by a pledge of the' stock of the S. 8. MeClure Newspa per corporation, had been surren dered to him in exchange for tho 100,000 note In September, 1917. In other words, 1y giving his note for $100,000 he had obtained a return of notes aggregating In excess of $1,300,000, and stock representing a controlling Interest In the Evening! Mall. "Rumely has claimed recently that company, executor of the estate of (Herman Slelcken's estate, state that so far as they know, Mr. Slelcken had nothing to do with this transac tion. ' In a statcmont Issued late last night, Assistant Stale Attorney-General Becker said: "The entire amount which' went into the purchase of the Evening Mall was derived from tho salo of German war bonds In this country, and Amer ican citizens furnished the money to acquire the paper, which was to lie used for the purpose of carrying on German propaganda. "While the deal was made with Henry L. Stoddard for tho paper, thore is no evidence that Mr. Stod dard knew It was German money. Mr. Stoddard retired from the manage ment of tho paper and still holds most of the outstanding bonds. When the United States declared war against Germany, Mr. Stoddard threatened to foreclose the bonds unless the Evening Mall expressed loyalty to this country In every way.' Fair lo Germany. Mr. Stoddard said that he had known for two weeks the govern ment was searching the source of the funds, but he was astounded to hear tho money was obtained In the man ner charged. "Just boforo this country entered tho war, I Insisted to Dr. Rumely that the course of the paper should be unswervingly, unhesitatingly and ag gressively patriotic and loyal," said .Mr. Stoddard. "I told him unless this was done, tho bonds would be foreclosed at their maturity on Oct. 1, 1917. From that day to this, as the government Btates, tho paper has been strongly and helpfully for the war, and for tho principles for which wo are fighting. 'Timo and again, when I asked Dr. Rumely whore his money came from. in view of tho rumors abroad, he gave me his word of honor every dollar of It came from American citizens of German parentage. II insisted that up to tho time of our entering tho war all that ho wanted to do was to bo fair to Germany, against England." According to Mr. Becker, St. Louis contributed $100,000 from the sale of Gorman war bonds, and Chicago $200,000. This money was first de posited to tho credit of Dr. Albert and Count Von. Bornstorff, with the Enuitablo Trust company In New York and eventually reached Rume ly. Mr. Becker added that $300. 000 of tho fund collected was deposited with tho Hanover National bank and $200,000 with the Columbia Trust company. King of Disloyal Workers. An order drawn on the Farmers' Loan & Trust company for $185,0(10 in favor of Lyon was signed by G Amslnck and company, according to Mr. Becker, who assorted that this company was tho ono of which Adolph I'avenstedt, now interned, was managing partner.
