Mr. Woi-tliintoii, who had no liquor in bi car nnd was not resisting arre.-t, will a suit lor damages. Worthinton was returning from a visit to some mining claims, and had a number of valuable ore specimens locked up in the rear of his ear. . He hart stopped on the mountain to put water in the radiator, and was just about to o on when l.ee, wearing a deputy sheriffs hude, called to him to stop as he wanted to search his ear for booze. Worthinton stopped while the deputy searched the pockets nml underneath the seats of the ear. The deputy then tindinj: that the reiir box of the ear was locked up demand ed that Vorthiritoii open it and allow him to look through. This Worth ing on refused to do and explained that he had valuables in the compart ment that he did not want to be seen by anyone passing on the highway. Asked Scmrli Warrant. The Medford man defied the deputy to break open the compartment with out a search warrant, and invited the officer to place him under arrest, take him to Ashland, there et a search warrant and lie would open up the compartment. dbout this time Jason Ilartman of Jacksonville, another bpfulal deputy sheriff stationed on the mountain drove up in a Ford ear and look part in the dispute. The smaller deputy addressing (lim as "sheriff," explain ed that 'orthiniton refused to allow him to search the compartment with out a warrant. Lee placed his hand in his hip pocket and threatened to draw his revolver. Worthinton dared him to, do so and the deputy then withdrew his hand from the pocket. Trictl Handcuffs. Worthinirton waa seated with' hi- hands on the steering wheel ready to f,ro ahead whenever they said tin word, and suddenly Ilartman made a liin.e at bis wrists with a pair of handcuffs ami repeated tho operation several times, Worlhiuulon each lime pulling his arms away in lime, 'flic hitter was so indignant over Ihi. treatment, which he says is only banded out to thiis and murderers and not to reputable citizens, that he declared they could only place hand cuffs on him over his dead body. . More argument followed, Worth ins ton inviting the deputies to place him under arrest and lake him to Ashland. Ilartman finally announced that Worlhintou was under arrest nml with the bitter's consent iint in the car and rode with him to Ashland, and before Justice of the Peace dowdy. At the command of the, justice Worth inulon unlocked the compartment and the justice looked through it. Then tie-pile Justice liowdy's advice Ilart man iiiMMcd on swearimr out a war rant for Wi.r'hiiijilou'rt arrest on the charm' of resisting an officer.
