If such holder shall pay such local assessments, he shall be entitled to fifteen per cent (15) interest per annum on the amount of the delin quent assessments or delinquent in stallments thereof so paid, from date of payment. In any suit to foreclose any lien for ' general taxes upon miy pronerty, a copy of the comp:alnt shall be served on the Recorder of the city within five days aftei such complaint is filed. In any case where any property shall be struck orr to or bid In by too county at any sale for general taxes, and such property shall subsequently be sold by the county,: the proceeds of such sale shall first be applied to discharge in run the lien, or liens for general taxes for which' the same waB sold, and the remainder, or such portion thereof as may be necessary, shall be paid to the city to discharge all lo cal assessment liens upon such prop erty, and the surplus, if any, shall lie dtstttnuted among tho. proper county funds. REASSESSMENTS. Section 21. Whenever heretofore or hereafter the council has caused, or ' may cause, any street or alley to be .improved, or has. caused any sewer to be laid, and has, or may hereafter, assess or attempt to assess upon the property adjacent thereto or benefited thereby the cost of Buch Improvement, irrd said assessment by reason of any Siure to give any requisite notice or Dy reason of any other defect in the proceedings leading up to the making of such improvement or the levying of suc,h assessment, shall be declared to be void by any court, or If the coun cil shall be of the opinion that said assessment is illegal or doubtful by reason of any such omission or de fect, said council may cause the cost of fcaid improvement to be re-assessed against the property adjacent to said improvement or benefited thereby, in the following manner: The council shall declare by reso lution its intention to make such re assessment, which resolution shall briefly describe the improvement and shall declare the intention of the coun cil to assess the cost thereof upon the property adjacent to said improve ment, or benefited thereby, describ ing in said resolution each parcel of property which it Intends so to re assess and the amount it proposes to assess against each parcel. Such res olution shall fix the time and place for holding a meeting of the council at which all protests against re-assess- lng the costs of said Improvements against adjacent property, or property benefited thereby, shall be heard. Said resolution shall be published, the date of the first publication of which shall be at least ten days before tho date' of said hearing. At said hearing the council shall consider all protests against the levy . 'ig of such assessment, and if after Considering the matter tho council shall determine that the property ad jacent to said improvement or any other property has been specialty ben efited thereby, it may causo the cost of said improvement to bo assessed against said adjacent property, or other property specially benefited by said improvement to the extent of the special benefit so received by said property therefrom: Provided, how ever, that no parcel of property shall be so assessed unless the same has been described in the notice of inten tion to make reassessment above pro vided for, and no parcel of property shall be assessed for a greater amount than the amount designated therefor in said notico. In - determining the property to be assessed and the amount to be assessed against each parcel, of property, the provisions of the clurter and ordinance for making an original assessment shall be fol lowed by the council In making such re-assessment. The council shall have the right to assess any parcel of property for said improvement, notwithstanding the same may not have been assessed in the original assessment proceeding, in case the council find snid property specially benefited by said improve ment, and the provisions of the char ter relating thereto otherwise gives the council power to assess said prop erty. In making said reassessment, the council shall distribute the cost if said improvement between tho var jnus parcels ndjacent thereto or bene fited thereby In proportion to the ben efits received or the frontage of the pro)erty on said lmpro'emonts, as the case may he, assessing no parcel any greater amount than the actual ben efit received by it from said Improve ment, but the council shall enter no ass:.'.sment against any parcel of pronertv which has been previously assessed and which assessment has been paid. Any existing assessments bo reassessed shall lie marked "Can celled by Reassessment." Said reas sessment shall be declared by ordi nance and entered in tho lty lien docket nnd collected In the same man ner as the original assessments shall be collected under the provision of this charter and the ordinance of the citv. ORDINANCES AND RESOLUTIONS. Section 22. The common council shall pass all ordinances and resoiu tions necesBary and proper to carry out the provisions of this article VALIDATION OF IMPROVEMENT ASSESSMENTS AND BONDS. Section 2.1. Whenever the common council has made, or shall hereafter make, any assessment against prop ertv for any local Improvement an Unitized- by law anil this charter, and has in mnking such assessment acted sn good faith nnd without fraud, or 'shall hereafter act In good faith and without fraud, the said assessment shall be valid and enforceable as such and a Hen upon the property upon which the same purports tn be a lien: and all assessments heretofore or hereafter made by tho city author ities In good faith and without fraud, and all improvement bonds heretofore issued and intended to he refunded by the refunding Improvement bonds mentioned in section 6 hereof, are hereby declared to be valid and bind ing obligations and in full force and effect until paid or refunded as pro vided herein, and said assessments are nnd shall lie collectible as provided in ttiia article. ASSESSMENTS PAID DY JOINT OWNER. Section 24. Whenever any local as sessment, or Installment thereof, shall be paid, or any certificate of sale therefor be redeemed, or any Judg ment therefor be jiaid by any joint owuer or any property assessed for any local improvement, such Joint owner may, after demand and refusal, by an action brought in the circuit court, recover from each of his co owners the respective amounts of such payment 9'hich each such co owner Bhot'.ld bear, with interest thereon at ton per cent (10) per an num from the date of such payments, and costs of the action, and the joint owner making such payment shall have a Hen therefor upon the undivid ed interests of hiB co-owners in nnd to such property from date of such payment. CITY: MAY PURCHASE AT TAX -.' . , SALE. Section 25. Whenever any prop erty situate in the city shall bo offered for sale for general taxes, the city shall have the power to protect the lien or -liens of any local assessment outstanding against the whole or any portion of such property by purchase or otherwise. ACTS REPEALED. Section 20. All acts and 'inrls of acts of stato law and all parts of the city charter in conflict hercwitn ire hereby repealed: and all acts or parts of acts, either general or special, a. it, all parts of the city charter hi con flict herewith, are hereby rotiot'.lo.l in sofar as they conflict herewith oi rtv strict tho powers or duties herein con ferred upon said city or its Mayor or Council or other officers. Any acts or parts of acts, or parts of the char ter, herein repealed which are o-en-acted in form or substance in this not shall not he construed as pew enaot- ments, but as continuations ui,! amendments of such acts or parts of acts. PUBLICATION. Section 27. When this act requires notice by publication, such notice shall be published at least once in a news paper of general circulation in said city and published therein, hut in case no newspaper is published in sale city hen the newspaper of largest cir culation of said city therein and pub lished nearest to said city of Central Point, except as otherwise in this act provided. NOTICE TO RE MAILED. . Section 2S. In all cases of assess ments or Installments thereof becom ing due and payable, the city recorder shall mall to the owner of the plop erty assessed a copy of the notice re quired to be published when the post office address of such owner is known, but failure to mall the same shall not be fatal when publication is inado. ASSESSMENTS PAID IN ERROR. Section 29. Whenever, through er ror or inadvertence, any person shall pay any local assessment, or ins'.uil- ment thereof, upon the lands of an other, such payor may, after demand and refusal, by an action in the Cir cuit Court, recover from the owner of such lauds the amount so paid, and costs of the action. NEW PAVING BASED ON PETITION ONLY. Section 30. After this article shall become effective, the common coun cil shall not have power to levy spe cial assessments for paving hereafter to be made except upon petition sign ed by the owners, according to the records In the office of the county re corder. of property to an aggregate amount of a majority of tho llnean frontage upon the Improvement to be made and of the area wllhin tile limits of the assessment district to be cre ated therefor. ACTS TO BE LIBERALLY CON STRUED. Section 31. The rule that statutes in derogation of the common law are to he strictly construed shall have no application to this article, but the same shall be liberally construed for the purpose of carrying out the ob jects for which this article is intended. DISCHARGE OF LIENS. Section 32. Entries of payments of assessments and of installments, in terest and costs made under the pro visions of this net shall be made In the consolidated Hen docket aforesaid as the same shall he received, with the date thereof, and such payments made and entered in said consolidated lien docket shall bo and operate as a dis charge of such lien, to the amount ot such payment, and from the dato thereof. ENFORCEMENT OF SUBSEQUENT LIENS AUTHORIZED. Section 33. The enforcement of the Hen of any Installment or interest payment by any method herein thorlzed shall not prevent the forcement of the lien of any subse quent Installment or Interest payment by any method herein authorized when the same shall become delinquent. PENDING PROCEEDINGS. Section 34. If (my proceedings shall be pending for the enforcement of t he Hen or liens of any delinquent assess ment or assessments for paving sewers at the time this article becomes effective, the city may proceed with the enforcement of any such lien or Hens under tho provisions of law and the city charter and ordinances of said city existing nt the time of tno ink lng effect of this article, or under the provisions of tills article. OUTSTANDING CERTIFICATES OF SALE. Section 35. Tho holder or holders ol any outstanding certificate of sale heretofore issued for sjieclal assess ments for paving or sewers, may pro ceed with tho enforcement of tho liens of such assessments under the pro visions of law and the city chartr and ordinances of said city existing at the date tills article becomes effective or under this article. Section 36. This article shall lie In full force nnd effect and be a part ol the charter of the citv of Centrnl Point, Oregon, when approved by majority of the votes east thereon a an election hold In said city on tho 16th day of October. A. D. 11117. Section 2. Thnt the foregoing amendment to the charter of the city Is hereby adopted and submitted to tho legal voters of the city of Cen trnl Point for their rejection or nti proval, to be voted on nt a special election as provided In Section 3 this ordinance. Section 3. A special election hereby called and ordered to he held In and for said city on the 16th day of October, A. I). 1917, for the purpose of voting on the said proposed amen ment. nnd the city recorder is hereby dtrecten to give notice ol said election by publishing the same at least once; a week for two successive weeks prior tq said election lu a newspaixr of, general circulation published in said city, or in case: no jiews.papor la pub lished in said city, thou said notice shall be published In the newspaper ot largest circulation in said city and published neatest tn the city of Cen tra; Point, and hereby designated the official newspaper thereof, and by posting the said notice in at least three public and conspicuous places In said city, and said notice shall be pub lished and posted at least ten days prior to the dato of said election, which notice shall be In substantially the following form: SPECIAL CITY ELECTION NOTICE. STATE OF OREGON, - County of Jackson, City of Central Point, ss.: . Notice is hereby given that a spe cial election will be held in the city of Central Point. Jackson county, Oregon, on Tuesday, to-wit: the 10th day of October, A. D. 1917, between the hours of 9 o clock a. m. and 6 o clock p. m The polling place for1 said election shall be at the City Hall in the City of Central Point. Oregon, The three following nnmed legal votors of said city are hereby desig nated and apiHiinted judges of said election, two of whom shall act as clerks thereof: L. Hatfield, J. W. Jacobs, J. B. Holmes, Judges and Clerks of Election. Said election is called and held for voting niton the ndoption or- rejection of a certain nniendment to the charter of the City of Central Point, Oregon. adopted by the common council and submitted by the common council to the voters of the city.
