In. all cases of assess ments or installments thereof becom ing due and payable, the city recorder shall mail to the owner of the piop erty assessed a copy of the notice re quired to be published when the post office address of such owner Ih known, but failure to mall the same shall not ha fatal when publication is made. ASSESSMENTS PAID IN ERROR. Section 29. Whenever, through er ror or inadvertence, any person shall pay any local assessment, or Ins-jiil- ment thereof, upon the lands of an other, such payor may, after demand 'and refusal, by an notion In the Cir cuit Court, recover from the owner of such lands the amount so paid, and costs of the nction. NEW PAVING BASED ON PETITION ONLY. Section 30. After this article shall become effective, the common coun cil shall not have iower to levy spe cial assessments for paving horenfter to be made except upon petition sign ed by the owners, according to the records in the office of the county re corder, of property to an aggregate amount of a majority of the Ilnean frontage upon the improvement to be made and of the area within the limits of the assessment district to be cre ated therefor. ACTS TO BE LIBERALLY CON STRUED. Section 31. The rule that statutes In derogation of the common law are to be strictly construed shall have no , application to this article, but the r snme shall be liberally construed for the purpose of carrying out the ob Jects for which this article Is Intended DISCHARGE OF LIENS. Section 32. Entries of payments of assessments and of Installments, In terest and costs made under the pro visions of this act shall be made In (he consolidated Hen docket aforesaid ns the same shall be received, with the dnte thereof, and such payments made and entered In said consolidated lien docket shall be and operate as a dis charge of such Hen, to the amount of such payment, and from tne ante thereof. ENFORCEMENT OF SUBSEQUENT LIEN'S AUTHORIZED. Section 33. The enforcement of the Hen of any installment or Interest payment by any method herein au thorized shall not prevent the en forcement of the Hen of any subse quent Installment or Inlerest payment by any method herein authorized when the same shall become delinquent. PEXDINU PROCEEDINGS. Section 34. If any proceedings shall 1 pending for the enforcement of the Hon or liens of any delinquent assess mcnt or assessments for paving or Bewers at the time this article becomes effective, tho city may proceed with the enforcement of any such Hen or Hens under the provisions of law and the city charter and ordinances of said city existing at the time of the tak ing effect of this article, or under the provisions of this article. OUTSTANDING CERTIFICATES OF SALE. Section 35. The holder or holders of any outstanding certificate of sale heretofore issued for social assess- ments for paving or sewers may pro ceed with the enforcement of the Hens of bucIi assessments under tho pro visions of law and the city charter and ordinances of said city existing at tho date this article becomes effective or under this article. Section 36. Thi article shall be in full force aud effect and be a part of tho charter of the city of Ceutral Point, Oregon, when approved by a majority of the votes cast thereon at an election held In said oltv on the 16th day of October, A. D. 19i 7. Section 2. That the foregoing amendment to the charter of the city is hereby adopted and submitted to the legal voters of the citv of Cen tral Point for their rejection or ap proval, to be voted on at a special election as provided In Section 3 of tnis ordinance. bectiou 3.
