The "British admiralty manual of 1888 states in Article fit) I, covering the destruction of an eneinv vessel, "the com mander to remove her crew and papers, and, if possible, her cargo, and then destroy the vessel." The French instructions of December 10, 1012, provide in article !."!: "Before destruction you will place in safety the peisons, whoever they 'may be, who tire found on board." The "Russian prize regulations of 1897) authorize coin niiuideiM of cruisers "to burn or sink the detained vessel, after having first taken all the people off it." The (lernian prize regulations, adopted the fire I month of the present war. August, H)M, say in article 1 1(5: "Be fore proceeding to the destruction of the vessel, the safety of all persons on hoard, and, as far as possible, their ef fects, is to be provided for." The naval code of the Tnited States even goes farther, recognizing the right of an armed merchantman to resist capture by an American man-of-war. The right of merchantmen to arm has been recognized since the days of piracy. A century ago (ho United States supreme court settled the question. The American citi zen is by international law within his right when travel ing on armed merchant ships, which are not warships under any law, rule or custom. In October, 1007, The Hague tribunal adopted the fol lowing law, of which the (Senium emperor was author, and which received the votes of every (Senium delegate: "A merchant ship converted into a warship cannot have the rights and duties accruing to such vessels, unless it is placed under the direct authority, immediate control and resionRibility of the power whose flag it files. The erew must be subject to military discipline. Kvcry merchant ship converted into a warship must observe in its opera tions the laws and customs oPwar." I 'resilient Wilson is merely upholding international law. Whether such a contention is worth the risk of in volving the nation in war is where the difference exists between the executive and many members of congress.
