Newberry's chorus thnt tho court vas manifestly unfnir and prejudiced followed the overruling of rt motion offered by Newberry to ntrike out nil of the evidence submitted by City Attorney fioggs ns to Millar's method of conducting the. Manhattan cafe, on tho gronnd thnt it was in no wav connected with tho Itoyal Rooming howhc or with any immoral conduct on the part of Millnr. Newbury cited supreme court decisions as to such evidence, stating that it would not, in any court of law bo admitted. Chart's RallBg. "This 'court is not tho circuit court nor tho supremo court," declared tho mayor, "and this evidence will be ad mitted." "Then," thundered Newberry, "if this court is so all powerful that it can set nside tho circuit court, the supremo court and all of the law siuce tho timo of Blackstone, wo of fer a motion that tho court is preju diced and unfair.. Tho erideaco of the situation demand that wo do this." "You can appeal," answered City Attorney Boggs. "You bet wo can," retorted New bury, "and what is more, it looks ns if wol! have to. Futrher than that 111 bet you $50 that you will nover get the evidence. you have submitted lierc admitted before a real court of law." Mayor Refutes CtiABgrt Mayor Eifert then refused New bury timo to submit a motion for a chango of venue telling him to pro ceed with the case. Newbury stated that he would prepare and submit the motion anyway. Mayor Kifcrt .opened tho morning's session of tho trial with a brief re iteration of his statement Tuesday afternoon that ho intruded to bo en tirely fair to tho defendant. New. bury immediatel followed with hla motion to eliminate the evideuce con. ccrning the sale of liquor in the Man hattan cafe. "If the mayor really means what he says, and it b not a mere plati tude to tickle tho ear of the public, let him suit his act to this word and try' this defendant upon the crime charged in the complaint. What has his method of conducting his cafe got to do with an 'immoral act' at the Itoyal Itoomiug houso as alleged? If this evidence is admitted why not bring in the fact that ho probably btole a watermelon when ft boy. Let's try him for what the crime charged." Iloggs argued that tho evidence, was ndmishnblc inasmuch ns it tended to show Millar's desire to commit im moral and unlawful acts. Mayor Eifert' then ruled, prccipltatiug the chargo by Newbury. Bays Wltnctfee Wens Drunk. Mrs. Julia Jackson, who conducts the Itoyal Rooming house was tho first wttucss called Wednesday morn inc. J3ho testified thnt sho had never been Millar at tho Itoyal Itoomiug house except on busmess connected with his cafe. Sho said she had never seen or known of his commit ting an immoral act. She testified further that Ling and hlwood, who testified Tuesday aftcnipon, wero drunk wheu thoy visited tho Itoyal the night they saw Millar Icnvo without n tray, and that Millar had never. brought liquor to tho Itoyal. Overrule All Objections. Tho taking of tho testimony was punctuated ihruttrhuut with objec tions by Attomoy Newbury. In each enso ha qsked a ruling of the court and iu each instance Lifort's ruling was the same: "I'll admit tho evi dence." The city retded shortly before noon and Millar took Jbo stand in hra own defense. Ho testified that ho was in tho habit of vbiting Iho Itoyal Room insr houso to solicit orders for meals, and then delivering them. Sometimes. he tamed until the meals wero eaten and paid for. Ho also testified that his orders at tho Manhattan were strict in regard to the Halo of liquor. At 12:15 tho court' took a bhort recess for luuohcou. llc of Change Promised? That Menlo Davis, the boy whose evidence has been used as the back bone of tha testimony ngaiiibt Coun MM TRIA cilman Millar on the cttnrge of sell ing liquor to minors, had told thrni thnt ho wns to rocclxe n "piece of change" from Mayor Kifcrt for hN testimony, is the declaration made on tho witness slnntl iu the Millnr trial this nftcrnoou by Shine Edwards and Harry Campbell. Tho witness declared thnt Davis volunteered tho information to them thnt ho was getting n piece of change and thnt ho named Mnvor Eifert ns Ihe ono who was to pay it. That tho only liquor ho hnd ever been offered in Mcdford was given to him by Mayor Eifert in the mayor's home, was the testimony of George Qntes, a 10 year old boy. Mayor Eifert questioned the lad closely nnd remarked thnt he wn surprised tho boy would "lie in such a case." Offered to Withdraw. The trial of Millar was resumed Tue.day afternoon before n crowded house. Ou calling his court to order Mayor Eifert made n short statement in which he stated that rumors had spread around the city to tho effect that he could not give Millar n fair trial. He suggested the name of Glenn 0. Taylor, justice of tin ponce, as the trial judge, tho council having power to so appoint, but Mr. Taylor declined to servo. Other names were suggested but finally Mayor Eifert continued, the defense expressing it self satisfied. Harvey Ling was the first witness to bo called. Ho testified that on the night of Jnnunry 'io ho and "Ikv" El wood left tho Nntntoriuin where they had been drilling with the nntionnl guard and went directly to tho Royal rooming house. There they remained for two hours. On leading they testi fied that thev saw Millar leaviug the Royal and with a tray of dishes. Fol lowing Ling, Elwood was called, who told practically tho same story. They were also asked concerning the Man hattan cafe but gne little testimony as to its conduct. Probing Manhattan. Paul Schulcr and Norman Merrill were called by the city and asked concerning the conduct of the Man hattan. Although Millar is being tried for immorality much testimony was taken regarding the Manhattan and the salo of liquor. This evidence was taken over tho objections of At torney Newbury for the defense who declared thnt Millar was not being tried for selling liquor to minors but for immorality. Schuler nnd Merrill knew little of the Royal rooming house nnd had never seen Millar in that vicinity. AI Ucnniston, teamster, was called, and testified as to the Mauhattnn Cafe as did Robert Fryrcar, a for mer dishwasher, employed by Millar, and Everett McArthur, a high school boy, aged 18, who said he purchased a glass of beer at the aianuimnu a year or so ago. Officer Cingcado and Chief Hitt son testified ns tot he character of the Royal rooming house nnd as to tho conduce of the Manhattan Cafe. Neither knew of any carousals at the latter place.
