Instead, Attorney U'eompt Davis, Franklin's counsel, filed a motion to set aside, mid quash the information in both cneos against his client. Judge Willis named Saturday at 10 o'clock as the time for hearing the arguments on the motion. In setting forth the grounds for his motion and asking a later date for the arguments upon it, Davis created a sensation by declaring thnt ho in tends Friday to tile demurrers to the federal indictments returned against Olaf A. Tvoitmoe, A. K. Clancy, An ton Johaunsou and other labor lend ers, demanding thnt they be quashed. The grounds urged by Davis al leged that Franklin was committed illegally by a magistrate, there not being suffioient cvidenco to hold him for trial. REMOVED FROM OFFICE BY COUNTY COURT Had Charge of Work in Gold Hill Dis trict During the Past Season Complaint by Werkmen: J. W. Hayes, road supervisor in the Klovcnth district, comprising the Gold Hill region, win compelled by the county court Wednesday to make restitution of .?12G.14 'that he had drawn for road work during the past senson through nllegod padded pay rolls and dismissed from office. The list of county expenditures ns published by the Mai! Tribune showed that in many instances Hayes was drawing warrants for more money than the men employed by him re ceived. Their real payrool was com pared with the published payrool by the men, with the result that charges were filed with tho county court against the supervisor. Part of those overcharges, Hayes ucplaiued, were due to n verbal coli traot with the" comity mart whereby he was allowed $700 lo do n certain amount of work. As the actual pay roll was considerably uuder the .f700, he had padded the payrool to moot the amount duo him, having paid tho men bimelf instead of putting in a blanket claim for the $700. Excluding this $700 account, evi dence presented to tho court showed that Hayes had in other eases padded the payroll to the extent of $120.11, which he drew his check for. Only last week a petition was re ceived from Gold Hill asking the con solidation of three adjoining rond districts nnd the appointment of Hayes as supervisor over the consol idated district.
