Upon (be decision ol! tbe court bangs tbo validity of the $1,000,000 securities voted by tbe people. It would seem a clear cut issue between the red (ape of precedent so dearly loved by lawyers and common sense business methods resulting from popular rule. But (here is little precedent to go hy, direct legislation being a com paratively new thing. So the court will be blazing a trail. The brief filed for the countv bv Attornevs Realties and Lawlor is very interesting reading to the layman, thereby differing from most briefs, which seem dry. The issue at stake is whether tne constitutional amendment adopted by tbe people authorizing the incurring of indebt edness for permanent highways by counties is itself suffi cient authorization, or whether an enabling act defining tbo method of procedure is required. As the brief states: "The primary question involved will be whether the constitutional amendment under consideration is self executing. In other words whether the people meant to at once take over the power to issup bonds by voting them, or whether thpy meant to await the action of a legislature that might never act; or whether they meant to wait until they could again vote upon nut upon the ballot and voted tins constitutional provision was enacted." Speaking of tho growth of direct legislation in Oregon the brief calls attention to the fact that the people have already, by a constitutional amendment, denied to the legislature the power to meddle with their local affairs. They have taken away frqm it the power to enact or amend the charter. Tiny can fix absolutely their own limit as to indebtedness, or the manner of incurring it. These things thoy had in mind in the adoption of the con stitutional provisiqq in question. They wore seeking local self-government.' !kift Continuing the argument, the brief asserts: "The people can in this state enact an law not con trary to the constitution of the United States. If it con travenes the state constitution they do it by writing the law into the constitution. There is, therefore, no longer any reason in Oregon for looking to the legislature for count powers. It is absolutely impossible to look there for the powers of other municipalities of the state. "Why then should we adopt a policv whereby wo are bound to look to a legislative act for securities, when the people can make any provision upon this (subject which they desire, either by constitutional amendment or by a statute passed by a direct vote of the people? "Whatever reason there has been in the past for referring these matters to a legislature no longer exists in Oregon." Concluding the brief asserts: "Can any one point out what advantage to any county could be bad by the enact ment of any law by a legislature when that samp law could bo repealed by the people at will? If we have come to believe that all of tho power of the state is in its people, and that we are in favor of local self-government, tho will of the people ought to prevail." SPECIAL EDITIONS EEFLECT PROSPERITY. HP HE holiday season brought forth many special edi A' tions of newspapers setting forth the progress mado during the past year by tUo state in general and tbe dif ferent sections in particular. All of them reflect pros perity, j The Portland Oregouian issued its usual annual, re plete with dqta and statistics, elaborately illustrated, alto gether a most potent influence to attract immigration from the eqst, a newspaper alike creditable to the publishers and the state. The Eugene Guard surpassed itself by issuing a 72 page issue, devoted largely to Lane county and the bright future that awaits the university town. So far as known, tip's is the largest edition ever issued in Oregon outside of Portland. The Salem Statesman issued its -usual holiday issue, with its special feature printed pn book paper. .It is cal culated to attract the settler and spread the fame of the cup inn city. Perhaps the neatest and most attractive of the special ics was that of the Portland Spectator, which fills the issues place of a high class weekly in uu uuiiur papers oe us class tnrni tne spectator, Dut we have never seen them. Tho illustrated Christmas num ber, replete with short essays ijpoii the growth and deyel opment of city and state, is as valuable immigration liter ature as ever printed.
