THE Medford Traffic Bureau lias just had notice served on it by the state railroad commission that its ease submitted months ago has been consolidated with a case on its own motion which the commission has within the past month initiated, the reasou given by the commission for consolidating the Medford eaaes with its own ease is stated as follows "That the entry of an order according to the praver of the plaintiff will result in unjust dis crimination in favor of Medford and against other locali ties.M The following comparison is made between the form of prayer published by the commission for the guid ance of complaints and the iorm used m the Mcdtord peti tions: MXDrOKS'S PRAYER. The table of rates mentionel in the Medford petition are on the same scale for 115 miles as made by the commis sion on its motion in the matter of rates out of Portland; the form of the prayer is word for word Qf the prayer the commission publishes for such eases, the choice of reason able rates being left with the commission, and yet Med ford 's ease cannot be decided in her favor because it will "result in unjust discrimination in favor of Medford and against -other localities." Is not this a verdict by the com mission of its own guilt in aeordiug Portland rates that "result in unjust discrimination in favor of Portland and against other localities V The aetion of the commission in the Medford cases which have been opposed by Portland would have been the same had these suits been brought by Ashland, Roscburg, Eugene, Albany, Pendleton, or any other town in the state providing Portland had intervened and asked that the commission deny equal rates to such towns as the com mission had given to Portland. "What show does the interior stand of having its cases determined on their merits before such a commission? What is the use of going before that body for relief from the intolerable rate adjustment in the duplex system es tablished by the railroads to favor Portland as against the interior, and which the commission not only aims to pcr perpetrate, but actually increases the discrimination in favor of Portland and practically dismisses suits on the ground of the form of prayer which the commission framed itself when rates equal with Portland are asfted1? ' "What right under the law has the commission to hold up cases for months, when the law has been complied with, the case submitted on brief, and closed, then institute a suit qn itp own motion covering territory not involved in pending suits, and then proceed to consolidate the pending suits with its own motion, and purloin the evidence in the submitted suits to apply to its own case? No right! There is no such authority in the law. Furthermore Medford filed a suit for commodity rates from Portland to Medford which Portland tried to extend unlawfully to include less carload rates, and this suit the commission has proceeded to consolidate with a case it has brought upon which it can issue an order only upon rates applying between points outside of Portland, hence, the Medford commodity rate suit, so far as legal procedure in the civil courts will cognize, has been eliminated as no order made by the commission upon its case F-179, which is to take the place of Medford suits, will stand in the civil courts. Fine prospects and fine proceedings, this! ' The commission has authority either to grant Medford a reduction in rate or dismiss the suits, but the commission has absolutely no authority under the haw to juggle with cases after the maner it is seeking to do by consolidating them with its own case which aims to perpetuate the du plex system of one set of privileged rates for Portland and another discriminatory set for the interior. "What is to be done about it? The interior must make its own rates by the initiative. Medford and Baker have developed the attitude and purpose of the present commis sion, and for the interior to prosecute suits before this body means a warfare with satan, so what's the use. There is an easier way, a just way, a sure way and pleasant one.
