ANIENT CASE DRAGS ALONG Refusal of C. W. Ament to Answer, and His Pleas of Sickness Greatly Betard the Progress of Hearing- Involves Many Interests. An effort was mado on the part of tho plaintiffs in tho Golden Drift Min ing case to Imve It tried In open court, and as a result Judge Calkins convened court hero last Monday morn In, snyo tho Observer of Grants Pass. After hearing some of the case Monday forenoon ho decided that it would bo a long drawn out trial and ordered that the taking of testimony continue before the rof ereo. The attorney for tho plaintiffs com plained that C. W. Ament would not answer questions and tho court order ed him to answer questions and it ho refused that his refusal would count against him whon ho reviowed tho case. Tho reviewing of tho case by tho court will tako considerable tlmo as it has been found necessary to examine Mr. Ament on a, largo number of con tracts soparatoly, ho refusing to ad mit tho conditions of th contracts as 8 whole. Tho result is that each con tract lias to bo taken up separately and Mr. Ament examined as to their existence. , It seems that from the contracts that whero a commission was allowed Mr. Ament paid tho commission with personal stock and tho actual money tr&a transferred to his personal ac count, There aro very fow who attend tho bearing, yot part of the ovldenco is Tory interesting, and later whon wlt Beesee for the plaintiff tako tho stand It la said that tho facta that will ho divulged will be to aomo extent sen sational and especially is this oxpect- d when Mr. Sorenson taKoa me siauu picked nine. Tho clgnretto habit among small boys In Central Point Is fast reach ing tho danger stage, not only dau- ger to tho hoalth of tho lads, but dan ger of tire, ns tho matches and cig arette stubs aro carelessly cast away Into tho dry grass. Tho lads congre gate In remote places to "roll tholr pills." No ouo kcows whero thoy get "tho maklns' ". Today two fires were stinted In tho grnss below tho old mill, but tho lnds put them out and sought moro remote quartors. Tho practice b v. dangerous one. Mrs. B. C. Webb, living a. short distance west of town, Is quite so rlously ill of typhoid fover. Judgo A. P. Gellott was ablo to return to his duties at tho store to day and is fcel'ng greatly improved. ' Henry Clay Miller, cousin of C. L. ' Gant of tho Central Point Herald force, visited In town Thursday ovo-t nlng. Thero aro rumors that thero aro some features about tho way the company's affairs have been conducted that will be very Interesting and as stated somewhat sensational. Tho transcript of tho testimony now being taken by tho referee will bo a mammoth affair, and with tho testimony will bo volumes of papers and books of the company that havo been submitted in evidence and It will tako tho court somo time to review all tho evidence and render a deci sion. Tho taking of testimony has been very slow tho past week on account of Mr. Amont having sick spells and yes terday morning had to stop on ac count of his being taken sick. Tho taking of testimony began on tho ICth of Juno, but thoro was an adjourn ment of a couplo of weeks on account of Mr. Amont refusing to answer cer tain questions, and it was necessary to wait until the court could decide whether ho should anBver them or not. So far ho has been tho only wit ness examined, and it is likely that it will bo several daye before ho fin ishes. To nearly all tho contracts brought into question Mr. Norton, tho attorney for tho Amenta, takes exceptions, and tho unraveling of tho ovldenco after It Is all taken will bo a very largo task. I tell you, it is a document that covers the field thor oughly and I doubt if any man not thoroughly conversant with the in ner workings "of tho army and navy general boards could havo prepared that document. It is what army and navy mon have known, in n general way, for a long time." Tho speech by tho California con gressman, it is understood, wns pre pared upon data furnished by the publicity bureau of tho army and navy. It tells how easily a foreign foe could' occupy eithor tho Atlantic or tho Pacific coast of this country in very short time. Tho object of tho speech was to get congress to ask for a long report, which tho military authorities have ready to give, but which thoy could not present without being asked to do so. Of course, one object is to get bigger appropri ations for the national defense. Tho public in general has a feeling that too much money is being spent on tho nrmy and nnvy now, and it is thought that u little education will be necessary to get congress to loos en up tho purso strings and grunt moro money for men, officers, forti fications and modern guns.
