City Attorney A. J. Derby came up
from Hood River yeaterday and met
with the city council at a special meet
ing called at the Mosier Valley Bank

of determining the legality o f chang

Mosier.

Mr. Derby stated that there was no
general law regarding the exclusion o f
territory but that there is a general
law regarding the inclusion o f terri
tory by a municipality.
He stated
that such action had been taken before
but not in this state under the Oregon
system where the legislature haa no
voice in the matter. This reserves to
the cities to determine what they shall
or shall not do in auch cases. He
citied the case of Cook vs. the City of
Portland regarding the inclusion of St.
Johns.
It is the desire of the council o f the
City of Mosier to ascertain the manner
o f procedure and legality o f disposing
of territory relative to changing the
southern boundary line. The objects
■ re several, among them being to elim
inate a part of the county road, get rid
of Indian lands, and relieving the city
from the two bridges over Mosier and
Rock creeks. The city feels they will
be unable to bear the burden o f the
new bridge which will soon be neces
sary ; that it would make the taxes e x
orbitant. It ia their contention that
the county should take these over.

ing o f a special election to allow the
people of the city to vote on the pro
position to amend the city charter.
