Washington, A p ril 6. — Secretary
Knox was g ive n to understand today
by M inister Espinosa, o f Nicaragua,
that the Nicaraguan governm ent would
make an early effo rt to settle eith er by
compromise or by arbitration the claims
for damages o f the G. D. Em ery com
pany, whose concession for cuttin g ma
hogany was cancelled.
The m inister told the secretary that
a special commission would leave im
m ediately fo r this city, carrying full
instruction fo r the m inister, which
would empower him to reach a s ettle
ment. I f a compromise is not reached
the m inister w ill sign a protocol sub
m itting the case to arbitration.
The last communication from Secre
tary Knox to the Nicaraguan m inister
was in the nature o f an ultimatum.

in this country. The bill o f complaint
on the part o f the United States,
charging a violation o f the Sherman
anti-trust law, was filed in Novem ber,
1906. The Standard O il company, o f
N ew Jersey, the parent organization,
together w ith its various subsidiary
corporations; John
D. R ockefeller,
H enry M. F lagler, H enry R. Rogers,
John D. Archbold, O liv e r P. Payne and
Cnarles M. P ra tt are charged w ith hav
in g entered into an agreem ent, com
bination and conspiracy to restrain
trade and commerce among the several
states, to monopolize trade and com
merce in the purchase o f petroleum
and in the distribution, sale and ship
ment o f the products o f petroleum.
The United States seeks perpetually
to enjoin the defendants from doing
any act looking to carrying out the al
leged combination or conspiracy and to
dissolve the Standard Oil combination.
The governm ent concluded its testi
mony on January 21, 1909. About 400
witnesses w ere examined,

m ately 200 appearing for each side.
The issue is so important, that,
w h atever may be the result o f the trial
by the C ircuit court, the case certainly
w ill be appealed to the United States
