G row ers obtained a sig n al victory in a
su it a g a in st one of its m em bers, J. T.
W ooddy of B row nsville, Oregon, who
bad sold his 1922 wool clip in an o u t­
side buyer in violation of his m a rk e t­
ing ag reem en t w ith th e association.
Tlie case lias been in th e c o u rts since
Ju ly of 1922. Tlie asso ciatio n w as
aw ard ed liquidated dam ages of ten
cen ts per pound on all wool sold o u t­
side th e association, a tto rn e y ’s fees
and co u rt costs. T he d efendant a t­
tacked th e validity of the o rganization
of the association. The c o u rt found
th a t th e asso ciatio n was legally o r­
ganized and th a t th e co n tra c t witli its
m em bers w as binding and enforcible.
D efendant contended th a t tlie asso ­
ciation w as not en titled to any relief
in a co u rt of equity because he has
sold all of I lls sheep and hail gone out
of th e sheep raisin g businesa. But the
co u rt decided th a t as Wooddy owned
sheep at th e tim e th e suit w as tiled,
and at th a t tim e plaintiff w as en titled
to relief in a c o u rt of equity, tlie a sso ­
ciation w as en titled to dam ages, costs
and atto rn e y 's fees even though the
defen d an t ow ned no m nore sheep and
did not intend to own any.
