CDA fire annexation -Continued from PAGE ONE icy did include a fee waiver request for situ- ations when making the records available would primarily benefit the gen- eral public. “If the person making the request identifies this and it appears reasonable, I will do everything I can to waive the fees so that this information can be made available to the public and we can remain transparent,” said Smith. The board appeared to approve of the content but asked for some format changes before bringing the policy and form back for approval at the next meeting. Also at the meeting, the board discussed policies and procedures for an em- ployee handbook. “This is something that has been needed for a very long time,” said Smith, “so I hope the board will take it serious—very serious.” The board’s discussion began in open session but continued in executive ses- sion. Smith reported that the board’s legal counsel was “adamant” that the conversation take place in closed session due to pos- sible legal advice and law- yer-client confidentiality. No action was taken when they returned to public session. In other business at the June 24 meeting, Smith said the CDA has published a request for proposals for road work on the property. He told the board they will begin to evaluate pro- posals Aug. 4 and will hope- fully be able to publish an intent to award by Aug. 19, with a formal agreement by Sept. 19. With that timeline, he said, they could begin work on the 18-month road construction project by the end of September. Smith also clarified plans to withhold 30 per- cent of the construction budget to ensure the $12 million project doesn’t run over budget. The plan includes a five-mile road that will extend from Exit 10 on I-82 to the west side of the CDA property. The travel lanes are planned to be 14 feet wide and the road will have an expected lifetime of 20 years. Smith also updated the CDA Board on the Uma- tilla Electric Cooperative transmission line and the $5 million in funding toward the utility project. Smith said he had clarified the wording and that the money was not limited to only util- ities but also can be used for the roads and infrastructure necessary to the project. On a good note, Smith also reported that the CDA’s special district insurance had reimbursed the orga- nization $25,000 under its injunctive relief coverage. The payment is to offset the CDA’s legal fees in Umatilla County’s litigation against several other CDA members, including Mor- row County and the Port of Morrow. Regarding Umatilla County’s litigation against other CDA members, Smith said he thought it was get- ting closer to a resolution, though he didn’t have full details. He said that, while he didn’t have any say in negotiations, he did ask that the CDA’s legal fees be compensated by Uma- tilla County as part of any agreement. “That will be a decision between the county and the board,” Smith said. He said the CDA had racked up $33,370 in legal fees in May and June alone. As to a resolution of the lawsuit, Smith said he didn’t expect any settlement language before mid-July and added that it would probably be after Labor Day before the develop- ment authority could pro- ceed with any land division. He also told the board that, while they had au- thorized him “two or three times” to proceed with liquidating furniture and other assets on the property, he had “pushed pause” be- cause he realized neither he nor CDA Project Coordina- tor Emily Collins would be able to physically help with item removal if needed. “I’d sure like to get it done this summer,” he said, adding that he needed to put together a plan on how best to handle the liquidation. He suggested that hir- ing a local high school wrestling club might be a solution. Smith also reported that he ordered the 2023 audit required by the Base Realignment and Closure team and had put the CDA on the list for a 2025 audit. The cost of the audits will be $15,000 each. Hughes graduates from University of North Dakota Andrew S. Hughes of Boardman has graduat- ed from the University of North Dakota with a Bach- elor of Science degree in biology. Hughes was one of more than 1,700 students who graduated from the UND this spring, in ceremonies whose speakers included the governor of North Da- kota and a former Minneso- ta Vikings tight end—both of whom are UND alumni.
