For Public Review The public is hereby noti- fied of the availability of the Finding of Suitability to Transfer (FOST) for the closure, disposal, and re- use of Umatilla Chemical Depot (UMCD), Oregon. The UMCD, located east of Hermiston, in Morrow and Umatilla counties, was closed in August 2012 under the 2005 Base Re- alignment and Closure Act. Of the 17,148.72 acres, 9,540 acres will transfer out of Army Control to the local reuse author- ity, the Columbia Devel- opment Authority (CDA). The purpose of the FOST is to document the envi- ronmental suitability of the CDA parcels consis- tent with Comprehensive Environmental Response, Compensation, and Liabil- ity Act (CERCLA) Section 120(h) and Department of Defense (DOD) policies. In addition, the FOST in- cludes the CERLCA No- tice, Covenant and Access Provisions, and other Deed Provisions, and the Envi- ronmental Protection Pro- visions (EPPs) necessary to protect human health or the environment after transfer. Prior to the development of the FOST an Environ- mental Assessment was developed, in accordance with the National Environ- mental Policy Act (NEPA) and associated implement- ing regulations issued by the Council on Environ- mental Quality (CEQ), Code of Federal Regu- lations (CFR), 40 CFR 1500–1508 and the Army implementing regulation, “Environmental Analysis of Army’s Actions” (32 CFR Part 651). The EA and Draft Finding of No Significant Impacts (FNSI) underwent a 30-day public comment period in Au- gust 2016. Since then the Programmatic Agreement (PA) was amended, un- derwent a 30 day public comment period from July 15 to August 16, 2021. The FNSI was updated and un- derwent another 30 day public comment period from September 23, 2021 to October 25, 2021.
