It also kidnapping and appears that schools will not know what the legislature has in store for them until after school is out. In education, m oney is rape charges the question on everybody’s mind, in one way or another. When will the Legislature set the education budget? A ccording to Sen. Dave N elson in a conversation held in his office on February 17th, he feels the legislature will not answer that question until after the M ay revenue forecasts. With the new s from the M arch 1, 2003 forecast, one can understand their reluctance to venture a guess at this time. The legislature has found a way to not have education lose any m ore revenue after the M arch forecast, w hich we appreciate. There is an additional $224,000,000 loss in state incom e. The M arch forecast changes the picture for the 2003-2005 biennium . It m ay m ean that the recession m ay not have hit its lowest point (the May forecast may be even lower). It also changes what the legislature had determ ined was its starting point in putting the 2003-2005 biennium budget together. Many legislators’ feel this first two to three m onths is the sixth special session, since they are still dealing with the 01 -03 biennium. Som e tim e in March they will be able to begin w ork on the 03-05 biennium. Reading brings rewards for 2nd graders Francisco G utierrez Bernal, 27, o f Boardman, was arrested Feb. 26, 2003 and lodged in the Umatilla County Jail on charges o f Kidnapping in the First Degree, Rape in the First D egree, Sodom y in the First Degree, Sexual Abuse in the First Degree and Unlawful Sexual Penetration in the First Degree. Bernal is accused o f having kidnapped a child under the age o f 14 as she w alked home from the store the evening o f F eb. 25. H e is fu rth e r accused o f forcibly raping and sodim izing the child before Thirteen Heppner Elementary School second grade students received ice cream cones or milkshakes releasing her. Bemal plead not from the R& W Drive-In as a reward for earning at least 10 points in the Accelerated Readers program with Mrs. Clough and Mrs. Rill. guilty at his arraignment. After months o f discussion, having hired an attorney, a lobbyist, an educational consultant and an educational financial consultant, and having Sen. N elson introduce a bill in the Senate in early February, the Com m unity o f lone held a m eeting on February 11th and officially decided to secede from M CSD. This created many official questions and a barrage o f rumors. Many felt these questions would be answered and the rumors laid to rest during the process before the U m atilla-M orrow ESD w hen it acts as the Boundary Board. H ow ever SB 372, w hich m oved m ore rapidly than one expected, had its first hearing on Tuesday, February 18th. M any felt that an intention o f this bill w as to force the ESD Boundary Board to approve the request because SB 372 stated, “a rem onstrance petition or election may not be allowed on any request for a boundary change submitted to the district boundary b o ard .. W hich m any felt did not allow for the discussion needed to answ er the questions and settle the rum ors. A rem onstrance petition is the way the patrons show formal opposition to the act o f secession, even to the point o f forcing a vote o f the county to decide the issue. W ith the help o f the C o n fe d e ra tio n o f O reg o n S chool A dm inistrator’s (C O S A ) w e w ere able to explain that there was opposition to the bill, and it did have financial impact to the rem aining district, both items the lone lobbyist had indicated did not exist. We also expressed our concern that the passage o f the bill stopped due process as w e had expected to have w ith the U-M ESD B oundary Board. They agreed to delay a vote on the bill. In light o f these events, the M C SD B oard felt com pelled to take a position on SB 372, and called a special m eeting on Friday, February 21 **. The position they felt they needed to take to protect the best interests o f the children o f the district was to oppose the bill and asked to have it killed in committee. O ver the course o f the last weeks, we have been able to answer most o f the questions and clear up most o f the rumors: The lone attendance area does not include Lexington; the property owners in the new lone School District, if approved, will still pay taxes on all the bonds; they will have a separate transportation contract com pletely separate from M CSD; em ployees have the option to remain with M CSD. The lone committee understands that if they separate from M C SD , M C SD w ould not have any responsibilities to them nor w ould w e m aintain any special relationship with them. We w ould interact with them as we do w ith all surrounding districts, from the standpoint o f m utual benefit, or cash. W hich brings us to the m ajor concern for m ost people, the division o f Assets and Liabilities. During the time between the Com m unity o f lo n e ’s vote on February 11th, and today, m any people have made their views known to members o f the M CSD Board. The majority indicated that they are generally in favor o f allowing lone to secede from MCSD. Their concern is the division o f the assets and the liabilities. Oregon Law, in chapter 330.123, Division o f assets and liabilities upon changes in boundaries, explains how this is to happen. “Assets include all school property and moneys belonging to the district at the time o f the division. Liabilities include all debts for which the respective districts in their corporate capacities are liable at the tim e o f division. .. .school property shall be estim ated at its real market value.” The d iv isio n ... “ shall be m ade in proportion to the resident average daily m em bership o f the districts.” SB 372 uses the term o f average daily m em bership w eighted, how ever our attorney John Witty has received proposed language to amend the bill, which will use the language in ORS 330.123. The district does not have on hand the real market value o f the district that is require for O R S 330.123, there are com panies who are able to provide such information. We do have two sets o f inform ation that m ay establish the high and low values requested. Our insurance company provides us with replacement values o f the d istricts buildings and personal property. Replacement values may be higher than real market values. We also have the County A ssessor’s appraised value o f the districts buildings and grounds, which may be less than real market value. Therefore the amount owed is probably some where in between the two estimates listed. It was advised that the building was secure and owner made contact to inform that the alarm w asn’t set right. -M C S O re c e iv e d a rep o rt o f a possible m otor vehicle accident in Boardman. It wad determined not to be an accident but a disabled vehicle. -M C S O a rr e s te d Wesley Aaron Hendren, 25, on an Irr ig o n J u s tic e C o u rt warrant for Failure to Pay Fine/ Driving while Suspended. Bail was paid in full and subject was cited and released to appear at a later date. -M C S O re c e iv e d a report from a caller in Lexington that she had been receiving h a ra ssin g phone c alls and thought she knew who they were from. -M C S O re c e iv e d a report o f two vehicles driving too fast up and down the street and advised that one o f the vehicles had alm ost hit the caller’s car. -M C S O re c e iv e d a r e p o r t fro m a c a lle r in B o a rd m a n th a t h e r son r e c e iv e d a p h o n e c a ll threatening her husband. It was unknown who that caller was. -M C S O re c e iv e d a 911 h a n g -u p c a ll from a residence in Boardman. It was determ ined that all was okay and it w as a child playing on the phone. Dec. 31: M C S O received two 911 hang-up calls from a Boardman business. It w as determ ined to be wind causing a phone disturbance. -M C S O re c e iv e d a report from a caller in Lexington advised that she had received another phone call, but this time no one w as there. She later c a lle d to r e p o rt th a t she received yet another call and the subject had told her she was o u ts id e h e r r e s id e n c e . Bail was paid in lull and subject was cited and released to appear at a later date. -M C S O rec e iv e d a request for records from a probation officer. -M C S O rec e iv e d a r e p o r t fro m th e C ity o f H eppner that a dog with no collar had been found at City Hall and ow ner will have an impound fee. -M C SO cited Elena Ponce, 31, for M aintaining a Dog a Public Nuisance. -M C S O re c e iv e d a re q u e s t from th e F e d e ra l In v e s tig a tio n s P ro c essin g Center for a records check on four individuals. -M C S O rec e iv e d a report from a caller in Irrigon that her boyfriend was in the bathroom with a gun. While on the line the boyfriend came out o f the bathroom into the living room and was in his pickup outside when units arrived on the scene. It was determ ined that all was okay and subject was not suicidal and the call had been a false report. -M CSO ran gun from the above call through LEDS and received a hit on a stolen gun out o f Kennewick PD with the same serial number. MCSO was unable to get descriptor from K ennew ick PD , and attempted contact with owner o f gun that was stolen. They were able to reach him at a later tim e and he confirm ed along with the deputy that it was the same weapon. He w as lodged at the Umatilla County Jail. -M C SO deputy cited Daniel Duane Doyle, 39, for Violation o f the Basic Rule, 63 mph in a 45 mph zone and D riv in g w h ile L ic e n s e Suspended-I. -M C S O re c e iv e d a report from a caller in Irrigon that her son had been beaten up and possibly had a broken nose. -M C S O , O reg o n State Police received a report from U C S O o f a p o ssib le DUII; the vehicle was swerv ing in both lanes. -M C S O re c e iv e d a report from a c a ller at the H eppner Chevron o f a m inor m otor vehicle accident. The drivers exchanged information. -M C S O re c e iv e d a relayed report from a caller in Irrigon that w hen they cam e home there were two suspects in the residence. They left on foot towards Colum bia Junior High School. One saspect was identified. -
