Total Expenditures and Requirements Total Resources Morrow By Sean Griffin Eagle Newspapers SALEM In the rush of the final days of the 60th Legisla tive Assembly, one measure likely to emerge successfully from the stampede holds the promise of reducing the amount of shoplifting in the state. Recommended for passage by a House Judiciary sub committee following success in the Senate, SB 893 holds parents liable for the shoplift ing escapades of their children and allows merchants to extract penalties from the parents in excess of the value of the pilfered merchandise. The bill introduced at the request of the Oregon Retail Council, is patterned after similar legislation in the state of Washington. According to Dennis Gogolski, corporate security manager for the Payless Drug Store Chain, shoplifting losses in Washing ton have dropped 41 percent since the law was implement ed in 1975. Even so Gogolski, said, last year's shoplifting losses throughout the 80-store chain are estimated at more than $3 million. During that same period, store security person nel apprehended about 11,000 shoplifters a number Gogol ski considers only the tip of the iceberg. "With security personnel, our statistics indicate you catch about 1 out of every 10 shoplifters. Without security, that figure becomes about 1 out of every 35." Statistics like that, prop onents of the bill told the subcommittee during recent hearings, indicate the neces sity of such legislation in Oregon, where annual shop lifting losses are estimated in excess of $70 million. Opposition to the bill centers around the aspect of SB 893 that is probably most respon sible for its effectiveness the notion of parental responsi bility. Sen. Walt Brown, D-Lake Oswego, was one of seven senators opposing the legisla tion on the Senate floor. Brown, who unsuccessfully sponsored anti-shoplifting legislation in the 1977 session, says he is most concerned about the "vicarious liability" parents incur under provi , sions of the measure. Brown's ill-fated 1977 legis lation would have made parents liable for the cost of the stolen merchandise up to $5,000. In contrast, SB 893 essential ly makes parents liable for twice the value of the mer chandise plus an additional penalty of at least $100. In theory, at least, a merchant would be able to demand and could collect as much as $250.40 from the parents of a child who pilferred a pack of chewing gum. The least the parents could get off with is $100.40. If the parents balked at the payment, the merchant could seek a judgement through small claims court, eliminating much of the mer chant's cost entailed in seek ing relief through convention al court processes. The notion of civil penalties for the parents, agrees Pay less' security executive, is perhaps the least popular aspect of Washington's law especially among the parents of young culprits. "Parents are much more resentful," Gogolski said, "that they are responsible for their child ren's actions much more so than when they're apprehend ed for their own actions." Another concern about the legislation, voiced by Rep. Tom Mason, D-Portland, questioned the liability of guardians including the state Children's Services Div ision, which frequently serves in that role while attempting to place children in foster homes. Mason said he worried that the state would become liable for damages and penalties when minors in their care were apprehended for shop lifting. Mason additionally express ed concern that the penalties could be extracted despite a "not guilty" verdict in. any related criminal action.
