j IN THE COUNTY COURT FOR MORROW COUNTY, OREGON
IN THE MATTER OF CALLING A SPECIAL ELECTION ON
QUESTIONS OF APPROVING TAX LEVIES OUTSIDE THE.
CONSTITUTIONAL 6 PER CENT LIMITATION. ORDER
THIS MATTER coming on before the Morrow County Court
this 18th day of April, 1979, and
WHEREAS the Morrow County Budget Committee has met on
5 occasions to consider the county budget needs for fiscal year
1979-80 and has approved a budget as follows:

AND WHEREAS tax funds available without a vote of the
people are $347,160 (within the 6 per cent limitation) plus $195,000
from the three-year serial road levy approved by the voters on
August 8, 1978, for a total of $542,160,
f AND WHEREAS a total property levy of $1,559,937 is needed to
balance the said budget, of which $1,017,777 is outside the 6 per cent
limitation,
AND WHEREAS it appears necessary, in the judgement of this
County Court, to increase the amount of the tax levy over the
amount limited by the constitution in order to provide funds to
finance the costs of county government and to balance the 1979-80
budget,
AND WHEREAS it appears that the County Court has
authority under ORS 310.330 to call a special election on the
question of approving a tax levy outside the tax limitation set forth
in Article XI, Section 11, Oregon Constitution,
AND WHEREAS the County Court has decided to submit that
portion of the budget relating to the hospital separately, thus
requiring two separate ballots,
NOW, THEREFORE, IT IS ORDERED AS FOLLOWS:
A. A special election shall be held on the 22 day of May, 1979,
for the purpose of submitting to the qualified voters of Morrow
County, by separate ballot, the following two questions, to-wit:
1. Shall Morrow County be authorized to levy and
collect taxes in the sum of $419,190 outside the
limitation imposed by Article XI, Section 11, Oregon
Constitution, for the fiscal year commencing July 1,
1979, and ending June 30, 1980, these said funds to be
used to balance the county's 1979-80 operating budget,
excluding that portion of the budget applying to the
county hospital?
2. Shall Morrow County be authorized to levy and
collect taxes in the sum of $598,587 outside the
limitation imposed by Article XI, Section 11, Oregon
Constitution, for the fiscal year commencing July 1,
1979, and ending June 30, 1980, these said funds to be
used to balance the 1979-80 operating budget for the
county-owned Pioneer Memorial Hospital?
B. The explanations to accompany the two election questions
shall be hereafter certified over to the County Clerk by the County
Court's secretary.
C. The County Clerk for Morrow County shall be the Election
Officer and shall have the duty, power and authority to administer
this special election as provided by law.
D. The County Court has previously designated THE
HEPPNER GAZETTE-TIMES as the newspaper published and
circulated in Morrow County and in which ballot facsimilies and-or
election notices shall be published, and the County Court does
hereby ratify and affirm this designation for the purposes of this
election.
E. A copy of this Order shall be certified by the Court's
secretary and delivered to the County Clerk.
