HEPPNER GAZETTE-TIMES, Thursday, September 9, 1971 Public Notices NOTICE OF SPECIAL ELECTION ON SEPTEMBER 17, 1971 IN THE CITY OF HEPPNER. OREGON NOTICE IS HEREBY GIVEN that a special election has been called to be held in the City of Heppner, Oregon, on Friday, September 17, 1971. The polling place for said election will be the former Library Room of the City of Heppner on Willow Street in the City of Heppner and the polls will be open from 8 o'clock A.M. until 8 o'clock P.M., Pacific Daylight Saving Time. The election has been called for the purpose of sub mitting to the legal voters a charter amendment authorizing $94,000.00 bonds to procure funds for the reconstruction of bridg cs, streets, and swimming pool damaged by flood and the re location of utilities proposed to reduce further flood damage, as provided in the following resolu tion: RESOLUTION BE IT RESOLVED by the com mon council: Section 1. That a proposed amendment to the charter of the City of Heppner be submit ted to the legal voters of the City of Heppner, Morrow Coun ty, Oregon, for their adoption or rejection and a special munici pal election be held as herein provided. Section 2. That the date of the special municipal election when tiie proposition to author ize the sale of $94,000.00 general obligation bonds shall be sub mitted to the voters is the 17th day of September, 1971, and lhat the polling place be and hereby is designated as the for mer Library Room of the City of Heppner City Hall on Wil low Street of said city and the polls for the receipt of ballots shall be opened at the hour of 8:00 o'clock A.M., Pacific Day light Time and closed at the hour of 8:00 o'clock P.M., Pacif ic Daylight Time, on said date. Section 3. That the following qualified persons are hereby ap pointed judges and clerks of said election, to-wit: Margaret Siewert, Judge Fay Ferguson, Judge Ruby Becket, Clerk Hazel Bauman, Clerk Nina Snyder, Clerk Section 4'. That the recorder be and she is hereby instructed to publish notice of said elec tion and of said proposed char ter amendment in the Heppner Gazette Times, a newspaper published in the City of Hepp ner, once a week for two suc cessive weeks, the first publi cation thereof to be more than 15 days prior to the election. The recorder shall also post no tices of election in at least six public and conspicuous places in the city at least 10 days pri or to said election which posted notice shall state the time, place and purposes of the election but need not contain the full amendment. Section 5. That the proposed charter amendment referred to the City of Heppner by the com mon council be as follows: AN ACT To amend the charter of the City of Heppner, Oregon, by adding thereto Article VII au thorizing the reconstruction of bridges, streets, and swimming pool, damaged by flood and the relocation of utilities proposed to reduce further flood damage lor the City of Heppner; and the issuance of bonds in the sum of $91,000.00 to provide funds therefor. Be it enacted by tiu; people of the City of Hepp ner, Oregon, that the charter of said city be amended by add ing thereto Article VII to read an follows: ARTICLE VII (a) The common council of the City of Heppner, Morrow County, Oregon, is hereby auth orized, empowered and directed to Issue and sell general obli gation, negotiable coupon bonds of said city in a sum or sums not to exceed $91,000.00. Said bonds are to be used for the pur pose of reconstruction of bridg es, streets and swimming pool, damaged by flood, and the re location of utilities proposed to reduce further flood damage. Said bonds are to be in denom inations of $1,000.00 duly signed by the Mayor and countersign ed by the City Recorder, where by the City of Heppner prom ises to pay the bearer of each of said bonds at maturity there of the sum therein stated in lawful money of the United States of America, with interest thereon in like lawful money at a rate not to exceed 6 per an num payable semi-annually, each of said bonds to be a Gen eral obligation of the City of Heppner, and to be dated at a convenient time to be fixed by the common council to mature serially, as determined by the council, provided that the date of maturity shall not in any event exceed 20 years from the date of issue. The principal and interest of said bonds shall be payable at the office of the treasurer in the City of Heppner, and said bonds shall be known as "City of Heppner Flood Dam age Repair and Improvement Bonds 1971 and shall be ad vertised and sold as provided by the laws of the State of Ore gon. (b) That the debt limitations contained in the charter of the City of Heppner shall not ap ply to the bonds hereby author ized nor shall any other pro vision and limitation of said charter apply. (c) Council shall each year at the time of making the an nual tax levy for city pur poses, include such levy and sums sulticiont to be used jointly with other funds as may be received from operating reve nues to pay the interest due on the outstanding bonds of this issue and to retire the principal thereof at maturity. Section 6. That the proposed charter amendment here re ferred to the people of the City of Heppner by the common council shall be balloted upon at said time and place under the ballot title fixed by the council by this resolution as fol lows: AN ACT To amend the charter of the City of Heppner by adding Ar- icle VII thereto authorizing the issuance and sale of not to ex ceed $94,000.00 general obliga tion bonds bearing not to ex ceed 6 interest per annum, for the purpose of acquiring funds for the reconstruction of bridg es, streets, and swimming pool, damaged by flood and the re location of utilities proposed to reduce further flood damage. That the creation of a water control district and the con struction of dikes, and the in stallation of pumping plants and the construction of other surface water control works, will be of benefit to the lands with in said district and that the con struction of said works will be conducive to the public health, welfare, or safety.
