To be eligible for the Federal grant we had to make an inter agency agreement between the ports and the counties and apply for the grant that a late agency Is authorized to do planning for the state and major sectors of the state. This we fctranged to do and are now known as the Mid Columbia Planning Council. with myself as president. Judge D. K. The need for some kind ol land use planning was quite apparent, not only for the north Morrow coun ty but adjacent counties as well. In our efforts to organize the regional agency it lecame in creasingly apparent that we con tact reliable consul. ants, who might look at the area from an outside point of view. A nation wide consulting iirm was de cided upon. Some delay was en countered in securing funds un der the 701 project. Additional state legislation was needed. This was taken care of In the 11 session of our slate legis lature. Then Just last week, the Planning grant from the Housing and Home Finance Agency of1 funds for the work in the Mid- Columbia area was approved. We are now eligible for federal grant funds at the rate of 2 to 1 for monies expended in this pro cram. And the firm. Ebasco Services, Inc. retained as consul tants. We are also making arrange ments to hire an executive sec retary who will be expected to do a portion of the work in col- lectine existing data for the con sulting firm. DELIBERATE PREMEDITATED AND The punishment for first de gree murder is death or life in prison; for second degree, life in prison: for voluntary man slaughter, not more than 15 years in prison and a fine not exceeding $aO00. In each case there is killing on purpose, but with a difference, 1. First degree is a killing with malice aforethought a planned wanton killing, such as by poison, lying In wait, or torture. killing during other dangerous crimes such as robbery, burglary, arson, or . rape is first degree murder. 2. Second degree murder is any other killing with malice aforethought but lacking some element of first degree. or ex ample, It may be "wilful and deliberate, but not premed itated." The Jury may also find that it was not done during an otherwise dangerous crime, but during, say, a fight. Perhaps the killing may lack cruelty or viciousness, and hence no "deliberation." In view or tne killer's immaturity, intoxication, or state of mind, the jury may find the killing was not wilful. 3. Voluntary manslaughter, is not a killing in self-defense which is "justifiable homicide," but a killing one does on purpose but Drovoked bv the victim. Thus, no "malice aforethought." In his defense the accused may show the court that he was provoked enough so tnat tne court might speak of the killing in a sudden quarrel or neat of passion." Examples: An un provoked attack by the victim; a quarrel that breaks out into violence. Yet the jury can find murder I if there was malice aforethought, no matter how short the time to make it wilful, deliberate, and premeditated. Services February 3 For Gerald Harrison MONUMENT Services for Gerald Newton Harrison, 70, were held at Monument Com munitv church Saturday. Feb ruary 3. with Rev. Kenneth Thomas officiating. Mr. Harrison died January 30, at the Pendleton hospital. He was born In Aberdeen, Wn., June 8. 1891. the son of Isaac N. and Clara E. Harrison, who home- steaded at Top near Monument in 1903. He was a U. S. Army Veteran of the Mexican border incident of 1916 and of World War L He served in the army from 1914 to 1919. He is survived by a sister. Halla Omohunda of Gresham; three brothers, Zephyl of Her miston, Basil of Redmond and F. M. of Kinzua.
