THE. CITY OK BOARDMAN IKiES ORDAIN AS FOLLOWS: Section 1. This ordinance shall he known as the intetim zoning regulation ordinance of the Citv of Boardman, Oregon Section 2. No new commercial or industrial use ol land or buildings shall be permitted in the Citv of Boardman in any city block of a duly dedicated portion of the city or in any unplatted area in said city in which fifty per cent or more of the existing main structures are dwellings. Section 3. No new dwellings shall be permitted within the City of Boardman on any lot having an average minimum width of less than fifty feet or a minimum area of less than 10,000 square feet for the first family and no multiple dwell ing units or acimuonai awen ings shall be started unless and until a building permit secured from the City of Boaraman after application for the same shall have been mane to ana suui have been eranted by the Com mon Council of the City of Board man after recommendation and report of the City Planning Com mission has been requested bv and has been made to the said Common Council. Section 4. No new commercial or industrial use or iana or buildings and the construction of no new dwelling shall be started unless and until a build ing permit is secured from the City of Boardman, and no sucn permit shall be issued by the said City of Boardman unless the nrnnosed new use ol iana or building or proposed new dwell ing conforms with the provisions of this ordinance, unless appli cation for the same shall have been made to and shall have been eranted " by the Common Council of the City of Boardman after recommendation and re port of the City Planning Com mission has been requested by and has been made to the said Common Council. The applicant lor a Di-rmit under this ordinance shall make written application to the Citv Planning Commis sion of the City of Boardman, and send a copy ot tne appli cation to the Common Council of the City of Boardman. The application shall set forth the use to hp made of the lands, and the preliminary plans and specifications of the building or remodeling to be done upon the lands. Thereafter, within thirty days after receipt of the appli cation, the Planning Commission shall hold a public hearing upon the application and shall give public notice of the hearing, by posting notices in three places in the City of Boardman for a period at least 15 days prior to the hearing. At the public hear ing, the applicant may present us plans for the use ol the iana and other information to sup port his proposed use, and any other interested party may pre sent reasons either for or against the proposed use. At the public hear ing, the Common Council shall hear the recommendations of the City Planning lommlsslon, and the applicant and other Inter ested parties may present any recommendations they may have to assist the Common Council in Us decision; provided, that not less than five days prior to the hearing, written statements of any new proposal shall be presented to the Common Coun cil. After the hearlnf by the Common Council, it shall accept, modify, or reject the recommen dations of the City Planning Commission, and shall set forth in writing Its decision with sup porting reasons not later than 15 days after the public hearing; provided, that the Common Council may extend by reso lution and for good cause, the time for its decision, if it finds additional information and studies may be required for it to make a fair and equitable decision. If the City Planning Commission or the Common Council shall fail to act within the times above set forth, with out good cause, the application shall be deemed acceptable. Section 8. The owner or own ers of any building or premises, or part thereof, where anything In violation of this ordinance shall be placed, or shall exist, or be maintained, and any ar chitect, builder, or contractor who shall assist in the commis sion of any such violation, and all persons or corporations who shall violate or maintain any violation of any of the provis ions of this ordinance or who shall fall to comply therewith, or with any requirements there of, or who shall build in vio lation of anv detailed statement of plan submitted and approved thereunder, snail lor eacn ana every violation or non-compliance be deemed guilty of a misdemeanor and, upon convic tion thereof, shall be fined not more than one hundred dollars ($100.00). Each day that a vio lation ol this ordinance con tinues shall be considered a scp- nrate offense. Section 9.
