Portland, a candidate for congress, be allowed to have a picture of Sacajawea and a map of Western Oregon in the Voters' Pamphlet. Secreatry of State Earl T. New bry. whose duty it is to produce the pamphlet informed Lafferty that he would follow precedent and accept for publication only statements of candidates and their late bust photographs. Laf ferty took his rejection slip to the courts. He may have established a new format for the pamphlet. Chief Justice Earl Latourette who wrote the majority opinion said. "The respondent's theory that the secretary of state had discretion to determine the ap propriateness of submitted ma terial if followed would not pro vide for any mode of appeal and could not be controlled by man damus. Under this theory the secretary of state would be in a i position to exercise a tremomi- 3 4cious political power not content- ' plated by the lawmakers." In concurring, Justice George Rossman said, "One picture is worth 1.000 words. What a cen soring official might deem irre levant may in fact be a winning argument with the voters." Justice Lusk in his dissent on- 'laiawta or Mickey Mouse would have to be accepted be cause it might seem pertinent and germain to the candidate al though not to the secretary of state.
