That a special election will be held in the West Extension Irrigation District, Umatilla County, State of Oregon on Saturday, the 21st day of June, 1952, for the purpose of determin ing whether the Board of Direct ors of the District shall be autho rized for and on behalf of the District to enter Into an amenda tory repayment contract with The United States of America, acting through the Secretary of the In terior, in pursuance of the pro visions of the Federal Reclama tion Laws, these being the Act of June 17, 1902 (32 Stat. 388) and all acts amendatory there of or supplementary thereto. The form of contract proposed to be entered into is a draft designated "R. O. Draft-31752" which has been ap proved by the Secretary of the In. terior, subject to such modifica tions as appear desirable to the District's Board of Directors to conform to the requirements of the Secretary and the District as of the time the contract is pre pared for signature. Copies of the form of contract are available in the office of the District and the form of proposed contract appears in full attached to the minutes of the Board of Directors adopted on the 17th day of May, 1952, by which the Board approved the proposed amendatory repayment contract and called this special election. The form of contract and resolution are open to in spection by any elector of the Dis trict who is qualified to vote in this special election. The proposed amendatory repayment contract when executed by the parties there to, stated in general terms, will contain provisions relating to the following matters, among ii i others: (a) Restating the District's obligation, rights and privileges with respect to the construction, operation and maintenance, and repayment of the West Division of the Umatilla Federal recla mation project, and amending and superseding all prior con tracts between the District and the United States with respect to such nroiect.. (a) The Council hereby is author rized to acquire, construct, ln stall, operate, and maintain within or without the corporate limits of said City, a complete sewer system and sewage treat ment and disposal facilities and all equipment and appurtenances necessary, useful, or convenient thereto, (b) For the purpose of providing funds with which to effectuate the purposes of this section, the Council is authorized to issue and sell at public sale, general obli gation bonds of the City in the aggregate sum of Three Hundred Thousand Dollars ($300,000.00). The said bonds shall be in such form and shall bear such issue and maturity dates as the Coun cil shall determine, but all of said bonds shall mature within twenty-five (25) years from issue date. Should the Council so elect, it may issue the said bonds with the privilege reserved therein, of redeeming part or all of the bonds at par value and accrued Interest, tixn optional dates to be desig nated in the bonds. The said bonds shall be sold for not less than ninety-eight (98) per cent of the par value thereof and the full amount of accrued interest thereon. (c) The debt limitations con tained in the charter shall not ap ply to any of the bonds hereby authorized. (d) The Council hereby is auth orized and empowered to fix and determine rates and to collect charges for the use of said sewer system and facilities, and to pledge all or any part of the net revenues thereof, to the payment of the interest on, and to the re tirement of the principal of, the bonds hereinabove authorized. (e) So long as any of said bonds or any that may be issued to re fund them shall be outstanding, the Council shall include in the annual tax levy of the City a sum sufficient with the aforesaid net revenues of the said sewer system and facilities, to pay the Interest upon the principal of the said bonds as the said obligations re spectively become due and pay able. The said tax shall be lev ied upon an ad valorem basis up on all of the property within said City so taxable for its purposes. RESOLVED FURTHER, that the following ballot title is adopted for said amendment: CHARTER AMENDMENT Submitted to the Voters by the Council. Shall the Charter of the City of Heppner, Oregon, be amended by adding thereto Article , authorizing the Council to con struct a complete sewer system and treatment and disposal facil ities for said City, and the issu ance of Three Hundred Thousand Dollars ($300,000.00) bonds to defray the cost thereof, author izing the making of charges for use of the system, and a tax levy to pay said bonds. 100 YES. 101 NO.
