Page 6 Heppner Gazette Times, Thursday, July 191951 New Auto Accident Law in Effect August 2 A concise explanation of the puposes and requirements of Ore gon's new Motor Vehicle Safety Responsibility Law which is of immediate "interest and import ance to all motorists was made pubic today by Secretary of State Earl T. Newbry. "I hope all Oregon motorists will clip this article, read it over several times, and preserve it for future reference," Secretary New bry said. "It contains about all of the information an average motorist is likely to need, except in unusual circumstances. We have studiously avoided techni cal and legal language, so that everyone may have an accurate understanding of this important and necessary law. Here are the facts about the new law in question and answer form: What Is the Safety Responsibility Law? It is an Act of the Legislature to protect everyone in Oregon against financially irresponsible owners or operators of motor ve hices who become involved in accidents. It also promotes street and highway safety by facilitat ing the state's ability to remove habitual accident causers from behind the wheel. This law re places the present Financial Re ponsibility Law. Oregon's New Motor Vehicle Safety Responsibility Law Goes Into Effect August 2 Don't be caught without complete and proper insur ance protection when Ore gon's new Responsibility law goes into effect. RUGGLES Phone 723 Heppner When Does It Become Effective? It becomes effective on August 2, and on the same day repeal of the present Financial Law takes effect. Whom Does It Affect? It affects all motor vehicle owners and operators, including non-reident, (except vehicles owned by the United States, the State of Oregon or its political subdivisions, or any municipal ity therein), whein they become involved in an accident result ing death, injury or property damage. What Must You Do After an Accident? Within 24 hour after a motor vehicle accident resulting in death, injury or property dam age, the operator of every car in volved must file written report with the secretary of state. Offic ial forms for this purpose may be obtained from any regional office of the Secretary of state any sheriff's office, any police station, or from the secretary of state. Reports may be filed with any of the foregoing or sent dir ect to the secretary of state in Salem. Remember these requirements: You must report the accident re gardless of who Is to blame. If the operator of a car is physically incapable of reporting and is not the owner of the motor vehicle, then the owner must file the re port within 24 hours after learn ing of the accident. Failure to report is punishable by a fine up to $100. The secretary of state may also suspend any license of state sufficient cash to pay dam age claims resulting from the ac cident, "as determined by the secretary, but not to exceed $5,000 for death or injury to one person, $10,000 for death or injury to more than one person, and $1,000 property damage. Should you fail to do one of these things within 50 days, 10 days thereafter the secretary of state must suspend both your driving license and ownership registration. Such suspension will remain in force until you have met one of the above re quirements. In. addition, you must furnish proof of future financial responsibility for a per iod of three years, regardless of whether you met one of these re quirements before suspension. This is known as the security section of the law. It does not apply, however, if your car was lawfully parked or was being driven without your consent at the time of the accident. How Can You Protect Yourself? The law provides several ways. If you filed your accident re port and had in effect at the time of the accident some form of liability insurance or bond which covers damage claims up to a total of $11,000 the security sec tion of the law does not apply to you at all. Remember, how ever, that such insurance or bond must be in effect at the time of the accident and provide the fol lowing minimum coverage: $1,- 000 for property damage, $50,000 for death or injuries sustained any driver and the registration bv one Person, and $10,000 for of all vehicles registered in the name of an owner who wilfully fails, refuses or neglects to make a report of an accident. Can You Lose Your Motoring Privileges? Yes, both your driving license and ownership registration can be suspended very quickly under this law. Within 50 days after an acci dent in which a person has been killed or even slightly injured, or property damage to any one person, including yourself, ex ceeds $100, you may furnish the secretry of state with satisfactory evidence that you have done any one of the following things: Obtained a release from lia bility signed by the other par ties to the accident. Obtained a final court judg ment declaring you to be not liable. Executed a duly acknowledg ed written agreement providing for the payment of all claims re-' suiting from the accident, not ex ceeding a total of $11,000. Deposited with the secretary of OREGON'S NEW Financial Responsibility Law IN EFFECT BE SAFE... NOT SORRY... INSURE TOD AY... and be able to prove your financial responsibility with a FARMERS Auto Liability policy to avoid sus pension of your driver's license! 44 States, the District of Columbia, Hawaii, and eight Canadian provinces have financial responsibility laws which, upon occasion, require motorists to prove they can pay for accidents they cause within certain limits, or their driver's licenses will be suspended. WHY WERE THESE LAWS ENACTED? In the case of owners or op erators residing in Oregon, the insurance must be written by a company licensed to do business in this state. In the case of non residents, it may be written by a company licensed to business in the state where they reside. Owners of more than 25 motor vehicles may qualify as self-insurers. Provision for furnishing the secretary of state with in formation that you carried insur ance at the time of the accident is included in your accident e port. Be sure to answer all ques tions accurately and fully, and thus avoid suspension of your motoring privileges by mistake In Conclusion This statement is made public primarily to acquaint private passenger car owners and oper ators with the principal pro visions of the new laws that are most likely to affect them. Mr. and Mrs. Alfred Shirley of The Dalles spent the week end with his parents, Rev. and Mrs. A. Shirley, who returned to The Dalles with them for a few days where the Rev. Shirley went for a medical check-up. Delbert Emert purchased a four-wheeled show cart for his daughter, Mary, which has drawn much attention around here. Mr. and Mr. Frank Ellis of Vale are the parent of a son, Danny Scott, weighing 8 lbs., born July 10. Mr. Ellis is the 7th and 8th grade teacher here.
