Court Cases Postponed Until September Term The June term, 1926 of the cir cuit court for Morrow county was opened on Monday morning last, Gil bert W. Phelps, judge, presiding. Other officers pesent were Gay M. Anderson, clerk, George McDuffee, sheriff and J. S. Beckwith, court re porter. Wm. Ayers was appointed bailiff. Taking into consideration that it was now harvest time and many of those who were on the jury could not be in attendance conveniently at this time. Judge Phelps did not call the jury, and took action on such matters only as could be disposed of by the court. The jury will be call ed in September, at a date to be an i.ounced later, and then the regular work of the term will be taken up. The grand jury was in session on Monday and returned a report to the crurt. That body was not dismissed however, and will be at the call of the court to act on such matters as may it brought to their attention Trior to convening of court in Sep tember. No bills were returned by the grand jury at its setting Monday. Proceedings had on Monday and Tuesday, follow: Elmer Stamp vs. R. E. White and George R. White; settled and di missed. Gilliam & Bisbee vs. C. E. Ebi, et ux; settled and dismissed. Edgar Anderson vs. H. W. Ander son; dismissed for want of prosecu tion, by consent of attorneys for plaintiff. Bowman-Hicks Lumber Co. vs. J B. Kenny and Hugh O'Rourke; de fault for want of answer. F. R. Brown vs. John Day Irriga tion District; demurrer overruled by consent; 20 days allowed in which to further plead. Isaac H. Gobbell vs. F. J. Dutcher and Lillian R. Dutcher; settled and dismissed. Maggie Bowers vs. Charles B. Bow ers; dismissed on motion of plain tiffs attorney. Annie Marshall vs. John Marshall dismissed on motion of attorney for plaintiff because of death of parties. Elizabeth M. Keeney vs. Ida Mat lock, et al; judgment as per stipu lation. M. J. Fitzpatrick vs. John and Dan McDevitt; each party allowed 10 days in which to file written briefs. F. M. Broady, et UJt. vs. John Gray, et al.; findings and decree for plain tiffs. M. S. Corrigall vs. R. A. Thompson, administrator of estate of John C McEntire, deceased, et al.; appoint ment of S. E. Notson as guardian ad litem. State of Oregon vs. V. H. Stickles; two indictments; motion to suppress evidence allowed but denied as to dismissal of case. State of Oregon vs. K. K. Mahoney enters plea of not guilty on each of two indictments. State of Oregon vs Henry Bauer pleas of not guilty to two indictments. State of Oregon vs. John J. Kelly; plea of not guilty entered. State of Oregon vs. Cleve Adkins; two indictments; pleas of not guilty entered. At two o'clock Monday afternoon, Judge Phelps suspended the hearing of cases to consider the resolution offered on behalf of the late Clinton E. Woodson, an honored member of the bar at Heppner. The ceremony was not long, but it was impressive. Speakers on the occasion were Attor neys S. E. Van Vactor, C. L. Sweek, F. A. McMenamin and S. E. Notson, each of whom had been for a num ber of years intimately associated with Mr. Woodson as attorneys before the bar of the court in Morrow county and each of whom spoke words of eulogy and praise for a departed mem ber of the profession. The senti ments of each were well expressed in the resolutions presented and ordered by Judge Phelps to be made a part of the court record: In the Circuit Court of the State of Oregon for Morrow County. RESOLUTIONS. Whereas, a short time prior to the opening of the term of this Court just closed, the Honorable Clinton E. Woodson, who for many years practic ed with distinction and success as a member of the bar of this Court, was called from his labors here to an other sphere of action; and Whereas, it is fitting that the bench and bar of this Court pay a tribute of respect to the memory of our de parted member; THEREFORE, BE IT RESOLVED by the bench and bar of the Circuit Court of the State of Oregon for Morrow County, that the bench and bar of this Court recognizes that, in the passing of the Honorable Clinton E. Woodson, this Court and the bar of the State have lost an able advo cate and the community and State a valuable and worthy citizen. That we mourn the deprture of our friend and fellow member of the bar and realize that on many occasions and oft we shall miss his wise coun sel. That we cherish his memory and treasure the record of his public and professional services.
