Thorn, general counsel for the Association of Railway Kxecutives. He contrasted the outlook for the future with the "economic tragedy" of the pu nitive and restrictive system of gov ernmental regulation. "The new system," he said, "is an economic triumph of popular govern ment carrying out a new conception re garding the relationship transportation bears to the public welfare." He urged that adequate opportunity be al lowed for testing Its efficiency. Mr. Thorn said under the act a new con structive transportation policy calling for the preservation "in full vigor" of both rail and water transportation has now begun In earnest. "Men may still debate," said Mr. Thorn, "as to the adequacy of the legis lation which has been adopted, but there can be no reaonahle difference of opinion as to the Boundness or value to the nation of the new conception that has been accepted of the responsibility of government to the subjects which it undertakes to regulate and of the rec ognition of the fact that the credit of these carriers, on which thteir ability to perform their essential public ser vice depends, Is a matter of profound and vital public concern, and must, out of regard for the public welfare, be dealt with on reasonable and sound business principles. It remains now to give the new system a fair trial." Not only Is the Transportation Act now on trial, Mr. Thorn declared, but also the Interstate Commerce Commis sion, organized labor, the various state commissions and the carriers them selves. "The carriers are on trial, because an effort has been made to extend to them help of a substantial character in the performance of their public duties, and public opinion will hold them to a strict accountability for the fidelity and effi ciency with which these duties are per formed." The carriers, Mr. Thorn added, 'must be keenly alive to their own responsi bilities" and must "rise to the level of their enlarged opportunities and view their obligations from the standpoint of the public right and welfare."
