Notice of NOTICK IS HEREBY GIVEN that a Special Election will be held in the City of Heppner on the 23th day of October, 1919, for the purpose of submitting to the voters thereof the proposed charter amendments con tained in the following resolution: RESOLUTION WHEREAS, the present water supply is insufficient to furnish the City of Heppner and the inhabitants thereof with an adequate supply of pure and wholesome water for domestic use and for Are protection, now there fore BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF HEPPNER that the following proposed charter amendments be and the same hereby are submitted to the legal voters of said city for their adoption or rejection at a special election herein called to be held In said city as hreinaftr provided, to-wit: AN ACT To amend an Act, entitled "An Act proposed by the Common Coun cil of the City of Heppner, Morrow County, Oregon, to enact, provide and adopt a Charter for the City of Heppner, Morrow County, Oregon, to be submitted to the legal voters of the City of Heppner, Morrow County, Ore gon, for their approval or rejection at a special election to be held in said City on the 20th day of December, 1913, and to repeal all acta and parts of acts in conflict therewith," submitted to and approved by tho legal voters of said city at the Special City Election held therein on the 20th day of December, 1918, and to amend all other acts providing a charter for said city, or amending same theretofore or thereafter enacted by the Legisla tive Assembly or by vote of the people. BE IT ENACTED BY THE PEOPLE OF THE tITY OF HEPPNER, that an Act entitled "An Act proposed by the Common Council of the City of Heppner, Morrow County, Oregon, to enact, provide and adopt a Charter for the City of Heppner, Morrow County, Oregon, to be submitted to the le gal voters of the City of Heppner, Morrow County, Oregon, for their appro val or rejection at a special election to be held in said City on the 20th day of December, 1918, and to repeal all acts and parts of acts in conflict there with," submitted to and approved by the legal voters of said city at the Special City Election held therein on the 20th day of December, 118, and that all other acts providing a charter for said city theretofore or thereafter enacted by the Legislative Assembly or by vote of the people, be and the same hereby is amended by adding thereto Chapter X to read as follows: Chapter X. Section 1. For the purpose of procuring funds with which to purchase the right, title and interest of the Heppner Light t Water Company in and to its system of water works now supplying the said City of Heppner with water, together with all such buildings, grounds, reservoirs, mains, hy drants, engines and equipment used and connected with said system of wa ter works, as the Common Council may deem necessary, and to construct. keep and maintain a gravity system ot water works, in order to properly S and adequately supply the said city and the Inhabitants thereof with water, the water to be taken from a source from Willow Creek, tributary to the Columbia River in Morrow County, Oregon, and from such other sources tributary to said Willow Creek, as the Common Council ot said City of Heppner may deem necessary and advisable, and for the purpose of pur chasing all right of way, water rights, pipes, material and other cost of construction of said gravity system of water works, and for any and all the aforesaid purposes, the Common Council ol the City of Heppner is hereby authorized and empowered to Issue and dispose ot general obligation bonds of said city in the sum of One Hundred Thousand Dollars ($100,000), said bonds to be in denominations of $500 or $1000 each, duly signed by the Mayor and countersigned by the Recorder, under the corporate seal ot the City, bearing semi-annual interest coupons attached thereto, bearing the fac-simile engraved signature of the mayor anf recorder, whereby tho city shall be held in substance and effect, to undertake and promise to pay the bearer of each of said bonds at maturity thereof, the sum therein named, in gold coin of the United States of the present standard of value w ith interest thereon in like gold coin at the rate of five and one-half per cent (5) per annum, payable semi-annually, each ot said bonds to be a direct general obligation of said City of Heppner, and to be known as CITY OF HEPPNER WATER BONDS. Said bonds shall be dated at a con venient time to be fixed by the Council, the maturity or maturities to be likewise fixed by the Council, but not to exceed twenty (20) years from date, and the principal and interest of said bonds shall be made payable at the Fiscal Agency of the State of Oregon in New York City. Section 2. The debt limitations contained in the charter of said city shall not apply to the bonds hereby authorized. Section 3. The Council shall each year at the time of making the annual tax levy for city purposes include in such levy a sum sufficient to pay interest due on the outstanding bond of this issue and to retire the principal thereof at maturity. RESOLVED FURTHER that this resolution for proposed charter amendments submitted to the voters by the Council be filed with the Re corder of .the City of Heppner, for submission to the legal voters of said city, for their rejection or approval to be voted upon at a special election to be held as herein provided: RESOLVED FURTHER that the Council deems it advisable and does hereby and herein call and make necessary provision for the holding of a special election which shall be and hereby is called to be held on the 25th day ot October, 1919, between the legal voting hours on said date, and that said time be and the same hereby is designated as the time for holding said special election, and the Council Chambers in said City are hereby designated as the polling place therefor and the following named persons are hereby designated and appointed as and for the judges and clerks of said election, to-wit: John Hughes and W. G. McCarty, Judges; D. W. Boitnott, Anna Spencer and Mrs. Hanson Hughes, Clerks.
