ORDINANCE NO. 184.'
An ordinance to prevent male per
sons In the City of Heppner, who
are physically fit to perform some
useful servce, from remaining Idle
during the period of the war, pro
viding a penalty and declaring an
emergency.
The people of the City of Heppner
do ordain as follws:
Section 1. It shall be unlawful for
any male person In the City of Hepp
ner, who is physically fit to perform
some useful service, to remain idle
during the period of the war, and ail
such persons shall, during such per
iod be habitually and regularly enga
ged In some lawful business, profes
sion, trade, occupation or employ
ment for at least thirty six hours per
week, and any person refusing to be
so employed shall be deemed guilty
of a violation of this ordinance and
shall, upon conviction in the Recor
der's Court of the City of Heppner,
be punished by a fine of not more
than $50?00, or by imprisonment in
i he City Jail for a period of not ex
ceeding twenty five days, or by both
such fine and imprisonment. In no
case shall the possession by the ac
cuBed of money, property or income
sufficient to support himself and
those regularly dependent upon him
be any defense to any prosecution un
der this ordinance.
Section 2. In no case shall the
claim by the accused of his Inability
to obtain work or employment be a
defense to a prosecution under this
ordinance uuless it shall be proved
that the accused promptly notified
the Recorder of the City of Heppner
of his Inability to obtain employment
and requested that work or employ
ment be found for him and that
such employment was not furnished
him, and shall hold a certificate from
said Recorder that such application
has been made.
Section 3. It shall be the duty of
the City Recorder whenever any per
son shall Inform him of his inability
to obtain employment as aforesaid
to register forthwith tho name of
such person, together with his ad
dress, age and any other information
which he may deem necessary.
The City Recorder shall thereupon
assign, or cause to be assigned and,
It necescsary reassign, such persons
to the occupation as aforesaid, car
ried on- by the City of Heppner, by
the State or any county or municip
ality thereof, or by private employ
ers, engaged in agricultural, Indus
trial or other occupation of the char
acter above mentioned, and who ac
cepts the service of such persons; pro
vided, however, that no person Bhall
66 required to work under this ordin
ance any greater number of hours
per day than lawfully constitutes a j
day '8 work in the occupation in I
which such person is required to oi-
gage. In the event of the City Recor
der being unable to procure employ
ment for such persons applying as
aforesaid, it shall then be the duty
of the Recorder to certify to such
erson in writing.
Section 4. All persons required to
work under this ordinance shall re
ceive compensation of not less than
the wage or salary paid to others en
gaged in the same nature of work
to which each person is assigned'. If
any person Is assigned to work for
any department, board or commission
of the state, then the compensation
of such person shall be paid tohlm
by such department, board or com
mission, out of the approprlaton
made to it by the State. If any-such
person is assigned to work for any
county or for any municipality, or for
any private employer, then the com
pensation of such person shall be
paid to him by such county, munici
pality or private employer.-accepting
hs service.
Section 5. Any person falling or
refusing to do, or to continue to do,
the work assigned to him, or who, in
the meanwhile, has not become regu
larly or continuously employed in
some lawful, useful and recognized
business, occupation, trade, profes
sion or employment as aforesaid, shall
be guilty of a violation of this or
dinance and upon conviction thereof
shall be punished by a fine of not
more than $100.00, or by imprison
ment in the city jail not exceeding
twenty five days.
Section 6. In assigning any one
to work the City Recorder shall take
Into consideration physical conditions
and any other appropriate circum
stances of the person so assigned.
Section 7. It shall be the duty of
every member connected with the po
lice department of the City of Hepp
ner to seek and to continue to seek
diligently the names and places of re
sidence of able-bodied male, persons
within the City of Heppner not regu
larly or continuously employed as
herein provided.
Section 8. The provisions of this
ordinance shall not apply to persons
temporarily unemployed by reason
of differences with their employers,
nor to fona fide students during the
school term, nor to persons fitting
themselves to engage in trade or in
dustrial pursuits.
. Section 9. Inasmuch as this ordin
ance is necessary for the immediate
preservation of the public health,
peace and safety of the City of Hepp
ner in this: That there is urgent need
for every able-bodied man to perform
some useful service during the pre
sent crisis, therefore, an emergency
is hereby declared and this ordinance
shall be in force and effect from and
after its passage by the Common
Council and approval by the Mayor.

ORDINANCE NO. 182.
An ordinance defining the crime of
Criminal Syndicalism, providing a
penalty for the violating thereof,
declaring certain nuisances and
providing for the abatement there
of. The people of the City of Heppner do
ordain as follows:
Section 1. Criminal Syndicalism is
a doctrine which advocates crime, sa
botage, violence or other unlawful
methods of terrorism as a means of
accomplishing Industrial or political
reform.
Section 2. It shall be unlawful for
any person within the City of Hepp
ner by word of mouth or writing to
advocate or teach the duty, necessity
or propriety, of crime, sabotage, vio
lence or other unlawful methods of
terrorism as a means of accomplish
ing industrial or political reform.
Section 3. It shall be unlawful for
any person to print, publish, edit,
issue or knowingly circulate, sell, dis
tribute or publicly display, within the
City of Heppner, any book, paper,
document or written matter in any
form containing or advocating, adver
tising or teaching the doctrine that
Industrial or political reform should
be brought about by crime, sabotage,
violence, or other unlawful method
of terrorism.
Section 4. It shall be unlawful for
any person within the City of Hepp
ner, to oponly, wilfully or deliberate
ly Justify, by word of mouth or writ
ing, the commission or attempt to
commit crime, sabotage, violence or
other unlawful methods of teroriam
with intent to exemplify, spread or
advocate the propriety of the doc
trine of criminal syndicalism. .
Section 6. It shall be unlawful tor
any person to organize or help to or
ganize, or become a member vt or vol

blage of persons formed to teach or
advocate the doctrine of criminal syn
dicalism. Section 6. It shall be unlawful far

ment of any meeting, gathering or

ing industrial or political reform.
Section 7. Whenever two or more
persons assemble in the City of Hepp
ner for the purpose of advocating or
teaching the doctrine of criminal syn
dicalism such an assemblage Is un
lawful; and it shall be unlawful for
any person to voluntarily participate
therein by his presence, aid, or Insti
gation. Section 8. It shall be unlawful for
the owner, lessee or agent of the own
er in charge, or tenant of any pre
mises, building, place, room or rooms
within the City of Heppner, to know
ingly permit therein any assemblage
of persons prohibited by the provis
ions of this ordinance, or who, after
notification by the City Marshal tha'
the premises are so used to permit
such using to be continued by such
assemblage.
Section 9. That it shall be law
ful for the sheriff, or any of his de
puties, of Morrow County, Oregon,
and any constable in said County, and
the Marshal of the City of Heppner,
or any police officer of the City of
Heppner under the authority of the
City Marshal, to summarily close
without legal process, and abate as a
nuisance, any place, building, room
or rooms, or premises within the City
of Heppner in which any such assem
blage shall meet or intend to meet,
and any headquarters or place of bus
iness or any organization, within the
City of Heppner advocating or teach
ing the doctrine of criminal syndical
ism, and keep such premises closed
until such time as the owner, leasee,
tenant, or person in charge of said
premises shall give a bond In the pen
al sum of one thousand ($1,000.00)
dollars payable to the City of Hepp
ner, as liquidated damages, condition
ed that such place, building, room or
rooms, or premises shall not be used
for a period of one year from the date
of the execution of such bond, as a
place of meeting, assemblage, speak
ing headquarters or place of business
of any assemblage or organization ad
vocating or teaching the doctrine of
criminal syndicalism and that in the
event such place or premises being so
used that the principal and surety up
n such bond shall forfeit to the City
if Heppner as liquidated damages,
'lie sum of one thousand ($1,000.00)
Dollars, which bond shall be execut
ed by a surety company authorized
to do business in the State of Oregon,
or two good and sufficient sureties,
each of whom shall justify in an am
ount equal to the sum named in said
bond, which bond shall be approved
by the Mayor of the city of Heppner.
Section 10. That it shall be law
ful for the Sheriff, or any of his depu
tes of Morrow County, Oregon, or
my constable in said County, or the
City Marshal of the City of Heppner
r any peace officer of the City of
Heppner, under the authority of the
City Marshal to summarily disperse
any assemblage, within the city of
Heppner of persons for the purpose
of advocating or teaching the doc
trine of criminal syndicalism.
Section 11. The word "person'
used in this ordinance shall include
any firm or corporation.
Section 12. That any person vio
lating any of the provisions of this
ordinance upon conviction thereof in
the Recorder's Court of the City of
Heppner, shall be punished by a fine
of not more than one hundred ($100.
00) Dollars, or by imprisonment in
the city jail for a period of not more
than fifty days.
Section 13. Inasmuch as this or
dinance is necessary for the immedi
ate preservation of the. public health
peace and safety of the city of Hepp
ner in this: That there is urgent need
that the crops and property of the cit
izens of Heppner and Morrow County,
Oregon, be protected, an emergency
is hereby declared to exist and this
ordnance shall take effect and be in
force from and after its passage by
the Common Council ana approval by
the Mayor.

The people of the City of Heppner do
ordain as foiiows: I
Section 1. That no person shall
conduct, keep, manage, operate or
cause to be conducted, kept, managed
or operated, either as owner, lessur,
lessee, agent or attorney, any hotel,
rooming house or lodging house with
in the corporate limits of iiepnor
without having first obtained a li
cense from the U.y of Heppner so t)
do. All said licenses shall be issued
annually and sltail expire December
Jlst of each year. The fee for each
license shall be one ($1.00) Dollar
and no license shall be issued for less
amount.
Section 2. For the purpose of this
ordinance the word "person" shall
mean and include natural persons, co
partnerships and associations, and
shall include persons of both sexes.
The word "house" shall mean and in
clude hotels, rooming and lodging
houses.
Section 3. Nothing in this ordin
ance shall be construed to deprive
the council of power to revoke any license-
issued as herein provided.
Section 4. No license shall be is
sued to any person to conduct a hotel,
rooming house or lodging house with
in the city of Heppner unless such
person is of ascertained good moral
character; and when application fur
such license is made, the applicant
shall present himself in person to the
Common Council of the city of Hepp
ner, and at such time present to said
Council satisfactory proof of good
moral character. When application
for a license is made by or on behalf
jf a co-partnership, corporation or
association, such application shall be
made by the manager, officer, office,
agent or other person who will have
the charge and management of such
hotel, rooming house or lodging
house.
Section 5. No license issued un
der the provisions of this ordinance
shall be transferred or assigned.
Section 6. No person to whom a
license shall be Issued, as provided
in this ordinance, shall suffer, per
mit, or allow the hotel, rooming house
or lodging house to which such li
cense relates to be used as a house
of 111 fame, brothel, bawdy house or
disorderly house, for the purpose of
prostitution, fornication or lewdness
or suffer any lascivious cohabitation,
adultery, fornication or other immor
al practice to be carried on therein.
Section 7. Every person to whom
a license shall have been issued to
conduct a hotel, rooming or lodging
house shall at all times keep a stan
dard hotel register, in which shall be
Inscrbied the names of all guests or
persons renting or occupying rooms
in such house, which register shall
be signed by the person renting a
room or rooms, or by some one under
his direction. Such registration must
be made and after the name or nam
es inscribed or registered, the mana
ger of the house, or his agent, shall
write the number of the room or
rooms which such guest or person is
to occupy, together with the time
when such room is rented. All of

for any violation of this ordinance.
Section 12. For the purpose of de
termining the liability of any person
or persons to prosecution for viola
tions of any of the provisions of this
ordinance, it shall be sufficient to
show that such person was at the
time of the act of violation complain
ed of, the person in actual charge,
management or control of the house
in which such act is alleged to have
been committed.
Section 13. It shall be the duty
of any person In charge of sucu ho

the City of Heppner or of the State
of Oregon, upon demand.
Section 14. Any person found guil
ty of the violation of any of the pro
visions of this ordinance upon con

Court of the City of Heppner, shall
pay a fine of not more than one hun
dred ($100.00) Dollars, or shall be
punished by Imprisonment in the City
Jail tor a period of not more than
fifty days, and such license so issued
shall immediately be revoked and no
other license, shall be issued to such

rooming house or lodging house with
which said person shall be connect
ed with as having been the manage
ment or control. .
