Dick Johns of the Hill-Starkey garage is receiving a visit from his father this week. The elder Johns lives in Grant county. FOR SALE One 1-year-old grade Durham bull. Can be seen at Mc Roberts Livery Stable. At a bargain if taken quick. D. O. JUSTUS. Mr. and Mrs. Alex Green have been enjoying a visit from Mrs. Perkins and son. The husband. Captain Per kins, is now stationed at Camp Lewis, American Lake, Wash. Frank Anderson, Eight Mile farm er, has been very sick the past few weeks, being confined to his bed with bladder trouble. His condition is somewhat improved at this time. Mrs. R. M. Hart took suddenly ill the first of the week and was re moved from her home to the Hepp ner Sanatorium, where later an oper ation was performed. She is improv ing at this time. Mrs. Albert Bowker, local agent for the Hupmoblle, reports the sale of three of these cars during the week. The buyers were L. P. David Bon and John Blake of lone and Ben Swaggart of Lexington. Andy Rood, who was In from his Heppner Flat ranch Wednesday, re ports that after the heavy rain of Tuesday afternoon, an inch and a half of snow fell over that section. The fields were far too wet and soggy Wednesday morning to permit farm ing operations. Mrs. Phil! Cohn and daughter Eleanor have returned to their home in Heppner after making a visit of several weeks with relatives In San Francisco. Mrs. Cohn's visit at this time was made more particularly to see her son Harold, who Is now sta tioned at Goat Island, where he is a student in the radio training camp. CITY ORDIXAXCEH. That ordinance No. 126, entitled "An Ordinance providing for the con struction, erecting, changing, alter ing and repairing of sidewalks within the corporate limits of the city of Heppner, and repealing ordinance No. 76, entitled, "An ordinance provid ing for the building, erecting, chang ing, altering, repairing sidewalks within the corporate limits of the City of Heppner," be and the same is hereby amended to read as follows: Section 2. That whenever the Common Coun cil of the City of Heppner shall deem it necessary or expedient that a side walk or curb to be constructed or al tered on any street, alley or public place within the city of Heppner, (he Common Council of said city shall pass a resolution ordering such side walk or curb to be constructer or al tered and such resolution shall spec ify the time when the construction or altering shall be completed; and the Recorder shall use a copy of such res olution ordering such sidewalk or curb to be personally served upon the j owner of the property abutting such sidewalk or curb, if the place of resi dence of such owner be known, and if1 the place of residence of such owner be unknown then by publication thereof in some newspaper to be des ignated by the Common Council; tbat such notice shall be personally served or published for a period of at least ten days prior to the date fixed . by such resolution for the beginning of csuh construction or altering of such sidewalk or curb. Section 3. That after a sidewalk or curb has been built or constructed upon any street, alley or public place within said city of Heppner, the same shall b kept In repair by the owners of Uie lot or lots, respectively, adjacent to which said sidewalk or curb is con structed. Section 4. That when in the opinion of the City Marshal any sidewalk or curb is out of repair, he shall serve notice on the owner or occupant of the prem ises fronting on the portion of such amice ait Leima FRIDAY Eve, April 5th UNDER THE MANAGEMENT OF ' FRANK SWAGGART AND H. Everybody Come av sidewalk or curb needing repair, no tifying such person to repair the same Immediately; provided, that if such lot is not occupied, and the owner is unknown or can not be found within the city of Heppner, then such notice as herein provided for shall be posted in a conspicuous place on the prem ises, and such posting shall have the same effect as personal service or no tice. Section 5. That if the construction or altera tion of any sidewalk or curb ordered to be constructed or altered in ac cordance with section one of this or dinance be not commenced within five days after the date specified in the resolution provided for in section one of this ordinance the date for the beginning such construction or al tering, or if any portion of any side walk or curb ordered to be construct ed or altered in accordonce with sec tion one of this ordinance be not com pleted within the time specified in the resolution provided for in section one of this ordinance, for the com pletion of altering of such sidewalk or curb, the City Marshal shall have the same constructed or completed or altered; and if any sidewalk or curb is not repaired within five days after notice is given in accordance with section four of this ordinance then the City Marshal shall have the same repaired; and, upon ascertain ing the cost of such construction, al tering, or repairing, the City Marshal shall immediately notify the City Re corder of the same, who shall, upon such notification, immediately enter the same, together with the expenses incurred, in the "Lien Docket" against the lot abutting or fronting on the portion of the sidewalk or curb so consructed, altered or repaired. Sction 6. That upon the entry in the "Lelu Docket" as herein provided for, the City of Hppner shall have a lein upon the premises designated in such Leln Docket for the full amount therein recorded, together with interest thereon, and may proceed to foreclose the same in the manner provided for tnforclng city liens in Article IX of the Charter of said City of Heppner, approved February 10th, 1899. Section 7. That all sidewalks or curbs con structed or altered or repaired under and in accordance with the provis ions of this ordinance shall conform to the plans and specifications pro vided in Ordinance No. 175, and the amendments thereto, and ordinance No. 177, respectively. Section 8. That ordinance No. 76, entitled, "An ordinance providing for the building, erecting, changing, altering, and repairing of sidewalks within the corporate limits of the city of Hepp ner," be and the same Is hereby re pealed. , Section 0. That whereas the city of Heppner Is about to commence street improve ments, and there Is urgent necessity that sidewalks be constructed and re paired, and that curbs be constructed before such Improvement commences, It is therefore ordered and declared that an emergency exists, and this or dinance shall be in full force and effect from and after its approval by the Mayoi.
