Weed Dumps Ashland High 12-0 In Opening Game Here Saturday Weed high school used a perfect passing offense and an air-tight defense to take their first game eiqr won from an Oregon team by beating the Ashland high eleven last Saturday on the local grid iron by a score of 12-0, l>ed by a colored halfback, Fletcher, who shoveled short pass es over the line, flipped long ones past the Ashland backfield and ran like a deer if cornered, the Cou gars scored their total in the first half, Aquistapace going over standing up in the first quarter and Fullback Chiodo toting the pill 30 yards to pay dirt in the second quarter. The first try for point after touchdown was blocked and the second went wild of the uprights. The Californians were in scor ing position and piled up a greater number of first downs in the last half but a gradual tightening of the Ashland line and several last chance tackles by Quarterback Charlie Warren stopped their drives short of the goal line. For Ashland Warren was out standing for short gains through the line and Steve Fowler shone in the first half with some splen did long range punts. Probably the most exciting play for local fans came late in the gnme when Fowler threw a pass over left side of the line to Fur man Carter who gained 30 yards to midfield before being run out of bounds.. Sims, pin- ball machine agent, defled Sheriff Syd Brown's order to padlock or remove the devices, Brown's action was based on a recent ruling by the attorney general that the ma chines violated Oregon's anti-lot tery statute, and the court action was designed as a test case by pinball operators and owners who had hoped to reinstate their gam bling contraptions. Circuit Judge H. D. Norton, fol lowing a dozen divided ballots by the jury which had listened to more than thrve days of testimony and argument, in calling it a mis trial, declared "There is little hope of jurors, who have been deliber ating since 10:45 o'clock this morning, of ever reaching an agreement sufficient to either ac quit or convict.” A majority of 10 of the 12 jurors must be reached to acquit or convict. According to Ashland members of the jury, the element of "skill” claimed for the devices was never clearly demonstrated, nor was it shown that the machines were en tirely lacking in skill. The defini tion of a lottery given at the trial explained that, to be a true lot tery, the machines must have no element of personal ability to alter or affect payment of awards. Jur ors were "about evenly divided on whether the machine was governed wholly by chance.” explained one juror. The trial of Sims got under way at 3:30 p. m. Monday, and went to the jury Thursday morning fol lowing instructions by the court. George Roberts and William Mc Allister were defense attorneys, while Assistant District Attorney George Nielson aided the state.
