Several years ago Hcv K L Stevens, then of this citv, was riding ntar Sweet Home when he took a small boy into ride. A brother who saw the act claimed that he thought bis brother was being abducted, look a gun and shot the horse dead, lie was arreted tried at this city and acquitted. He wax one of the Rolf boys now under arrest for murder, in tampering with the switch that caused the railroad accident resulting in the death of Jack Miller. The Rolf boys are not very bright, and are said to be of an ugly dinpo sltlon. The noot-e lianqs ver them. TBKTUAIN WRICKBK't TItlAb. j The case of Herbert and Fred Rolls and W A Hill charged olth wrecking the S P train la.it Sunday evening near this city, came up for preliminary examination in Justice I lumphrev's court this nfternoon( the accused being represented by Judge Whitney, and the State appearing by 11 II Hewitt, District Attorney and Mr North, rup, of Portland. The defendants waived examination and asked the court to make an order that they be admitted to bail. The court refus- ed o allow the defendants to waive ex amination staling that il the parlies were guilty they should be In jail and if not they should be allowed llu'ir liberty. Dr W II Din i was called and testified as to the Jcfendan'.'s calling on him fur professional service Sunday. Next saw Hill Monday mot nip,.', w ho had a lame wrist and wanlci treatment. The Dr's testimony was substantially us heretofore published. Mr DeClark testified that he was on the tram when it was wrecked. lack Miller was badly burned and died next day. He examined the switch afler the accident The pin was out and nut removed. Search has been made and the pin has not been found. The snitch was locked after the accident. Removing the pin would not affect the switch except astoone rail. The result of removing pin w ould be the wreck that occurred. Thos Froman ttsti.ied, am acquainted with defendants. Have been in fosters and my employ for ten days. Left my place Sunday at 3 o'clock to go to town. Had conversation with Hill Wednesday morning about wreck. 11111 loin me mar there was a man in my employ who caus ed the wreck. Hill said they took the pin out and removed the rod and put a stone between the rails. He and Fred Rolf went on and told Herbert to come on. Herbert came on and said he had a pin of tht S P. They told him to throw the pin away which he did. Hill's arm was not hurt when he left mv olace Sunjay. Fred told me he krew nothing about the wreck. Hill said it was Bert that removed the pin. Hill said that'thev asked to ride on the Leb- non train but they w ere not allowed to do Eastern Oregon Crops. John S Nin son, of Nolin, wis in Pendleton to-day. He thinks the crop average in that section will be about ten bushels to the acre, which is rather disappointing' considering the prospect offered in the spring for a large yield. No National Bank in the North west In a place of the size of Albany makes such a heaitnr snowing as tne first tional Bank of this city, whose deposits are about $175,000, and loans and discounts, $154,306.63. First Valley Melons. Mr William Peacock handed the Democrat office to day the first Valley water me nr.s brought to the market. Though small they are of a good quality. H took the pin out and removed the rod. Hill said he hurt his arm by rolling on it. Talked with young Rolf but he denied everything. Hewitt, Hoffman, Burkhart and I went to the jail and talked with Rolf. Rolf said Hill took the key or pin about half out and he.Rolf, taok it and cameo 11 on up me iraca.
