The defendant’s attorney called the attention of the court to the fact that it was near beer, and not straight beer that was being sold; but though the statutes do not mention the new product by name it was contended by Dis trict Attorney Burdette that all malt beverages are covered by the statute in question, and cannot be legally sold unless the dispenser has a proper license. In the case of Laughter vs Cros field and Pickard vs Crosfield the cases are continued pending a re view of proceedings of the Justice court at Wasco in the case of Cros field vs Pickard and Laughter, partners. Crosfield sued to col Iect a bill, attaching some horses; after or about the time Pickard and Laughter dissolved as partners, each buying the other’s interest in the joint property; the suits against Crosfield are to enforce their individual rights of exemption from attachment on the horses, which is denied them as partners. The case rests on the point at law as to the regularity of proceedings in the justice court; if not regular the horses are now subject to the bill of sale given by the partners to each other when the partner ship was dissolved and the law of exemption prom ts from attach ment.
