A 47-foot motor lifeboat crew from Station Tillamook Bay in Garibaldi received a single call from the mariners at 7:35 a.m. Sunday. The crew started searching around Nehalem Bay for signs of distress. A second call came into the boat crew, a witness reporting a capsized vessel at the mouth of the Nehalem River. The boat crew made it to the scene and rescued the mariners by 7:55 a.m. The men were taken back to base, where they declined medical attention. “These two individuals are alive today be- cause they were wearing their life jackets,” Petty Oficer 1st Class Joshua Sheppard, cox- swain of the rescue boat, said in a statement. “We saw them go under the water and resur- face several times as we came alongside them to pull them aboard.” Balzer suit goes to federal court LYRA FONTAINE/CANNON BEACH GAZETTE American Legion volunteer Scott Cameron serves up a piece of ham to Commander Dan O’Reilly. Balzer, who served as ire chief from Jan- uary 2012 until he was ired, has claimed the ire district’s board retaliated against him be- cause of critical comments made by his wife, Colleen, on social media. According to the lawsuit, directors Clyde, Beck-Sweeney and Smith “chastised” Balzer for “allowing his spouse to express her criti- cism of board members on social media web- sites and in her speech.” Balzer alleges that the district and board vi- olated his free association rights, in that Bal- zer’s “intimate association with his wife” is “entitled to protection under the First Amend- ment.” “The conduct of defendants Clyde, Smith and Beck-Sweeney were reckless or showed a callous indifference to plaintiff’s constitution- al rights,” Balzer’s complaint states. The three directors named in the lawsuit prevailed in a special recall election in April. Attorneys for all parties did not return re- quests for comment. “We started this last year to recognize irst responders and their families,” Commander Dan O’Reilly said. The Legion also had a cere- mony with the playing of taps to commemorate the sacriice made by people in uniform on Sept. 11. Con- tacted male, who had two crabs, and advised that harvesting prohibited at or near Haystack Rock and there are regulations. The male returned the crabs. A restaurant located the female and the oicer transported the husband to the female. Sept. 14 1:10 p.m., 200 Block North Hemlock Street: Theft of earrings, later recovered. 5:05 p.m., Beach, Chapman Point: Com- plaint of a subject climbing up the rocks, dropping rock debris on subjects below. Oicer arrived on scene and was unable to locate the subject. 8:03 p.m., 200 Block West Second Street: Fireworks ofense. Sept. 17 10:39 a.m., 1100 Block Ecola Court: Subject was arrested for menacing and transported to the Clatsop County Jail.
