H DAMAGE SUIT
Case which has been
in courts since 1905
brought to close in
Condon Tuesday.
The case of The Arlington and
Pacific Coast Railroad Co. vs.
the 0. R. & N. Co. for alleged
infringement of their right-of-way
between this place and Ar
lington, which has been in the
courts since 1905, was brought
to a close in Condon Tuesday
noon. The trial was set to ap
pear before Judge Bean in the
court house Tuesday. The plain
tiff failed to appear and the de
fendant aked for a trial by jury,
which was granted, the jury
consisting of Oscar Veatch, P.
Dyer, Henry Wilkins and Otis
Jarvis. The defense brought
forth their witnessess who were
examined and gave their testi
mony. The jury found a ver
dict for the defense and the
court entered judgement against
the plaintiil for costs. The
case filed by the plaintiff was to
the effect that they had made a
survey for a proposed road be
tween Arlington and Condon
about March 1, 1903. An engi
neer named Beel, who hacj in his
possession maps and original da
ta covering a part of the right-of-way,
skipped out and gave
them to the O. R. & N. Co, with
the result that they were enab
led to build the road to Condon
much easier than if the papers
were not in their possession and
v that they confiscated the plain
tiff's right-of-way to a great ex
tent. Arthur C. Spencer ap
peared for the defense.

The Condon Athletic Club will
present a vaudeville in the Skat
ing Rink Monday, Jan. 31st and
their program consists of about
a dozen numbers, each one of
which will be a feature in itslf.
There will be a forty-minute
farce, the cast for which will be
publisedin these columns next
week; four athletic specialties,
by the best athletes of the Club;
three vocal solos rendered by
Condon's best singers; a reading
by Miss Fitzmaurice, who is a
favorite with all Condon audien
ces; a piano solo by Miss Brown,
and a sketch by Mr. and Mrs.
William Gross, which promises
to be very good as these young
people rank high among the am
steurs of Oregon and have won
for themselves an enviable repu
tation. In fact, in every num
ber the parts are to be taken by
the best available talent the
town affords, so the people who
attend the performance are as
sured a pleasant evening's en
tertainment And, incidentally,
the proceeds will be added to the
building fund. Popular prices,
25, 35, and 50 cents.
The entertainment committee
consists of Fred A. Edwards to
whose careful management a
great deal of the success of the
play "Uncle Ruba" recently giv
en by the Clnb, is attributed,
Marcus Portwood, who is a prom
inent factor in the plays given
in Condon during the past year.
and Ray Tracy and Harry Fitz-
maunce. Turn out and give the
Club a boost
At the regular meeting of the
Board of Trustees last evening
it was decided to buy the billiard
table from the old commercial
club who made them a very , flat
tering offer, showing their good
will and faith in the Club. It
was also decided that it would be
necessary to remodel the build
ing to some extent in order to ac
commodate the table which work
will be commenced at once. A
small charge per game will be
made to the players, and it is
thought that in this way the ta
ble can be paid for in a much
shorter time. The resignation
from the Club of 0. C." Veatch,
who is soon to go to Fossil, was
accepted although much regret
was expressed at losing a mem
ber of Mr.'Veatch's standing.
The Entertainment committee
was instructed to make arrange
ments for a reception to be given
the members of the Club and
their friends which will take
place at the Clubhouse within a
few weeks, it is thought on St
Valentine's day. The applica
tion of Walt Graves to become a
member of the Club was favor
ably reported. The usual bills
were allowed after which, the
Board adjourned until their next
regular, meeting. .", M

For the past five years the
eyes of the eastern people have
been turned to the west In no
other locality have the people
shown such a keen desire to come
to a country where the climate
is almost semi-tropical. 1 The
words of Horace Greeley "Go
west young 'man and grow up
with the country", is the by
word of the people who desire to
seek their fortunes in a place of
plenty. A people that are look
ing for literature relating to the
country which has set the hearts
of all easten men aglow; a coun
try to which they desire to come
in order to avoid the rigors of
the severe winters, is their wish.
The West is on the tongue of
nearly all eastern men. If they
themselves have not seen it some
of their friends have been here
to see the wonderful opportuni
ties which lie dormant to be tak
en up by the men who will cast
their lot among us, and labor for
the fruits which nature has lav
ished upon the western people so
generously.' They hear about
